representative has been served with legal process or otherwise <br /> joined in a proceeding relating to such amounts , (ii) the <br /> Participant has been notified of the pendency of such proceeding <br /> in the manner prescribed by the law of the jurisdiction in which <br /> the proceeding is pending for service of process or by mail from <br /> the Employer or a Plan representative to the Participant ' s last <br /> known mailing address, and (iii) the Participant fails to obtain <br /> an order of the court in the proceeding relieving the Employer <br /> and the Plan from the obligation to comply with the judgment, <br /> decree, or order. <br /> 8 . 6 Participation in Legal Proceedings . Neither the <br /> Employer nor any Plan representative shall be obligated to incur <br /> any cost to defend against or set aside any judgment, decree, or <br /> order relating to the division, attachment, garnishment, or <br /> execution of the Participant ' s Account or of any distribution <br /> therefrom. Notwithstanding the foregoing, if the Employer, the <br /> Plan, or a Plan representative is joined in any such proceeding, <br /> a Plan representative shall take such steps as it deems necessary <br /> and appropriate to protect the terms of the Plan. <br /> ARTICLE 9 - TERMS OF FUND INVESTMENTS <br /> 9 . 1 Use of Fund: Except as otherwise provided herein, <br /> the Fund shall serve as the exclusive investment vehicle for <br /> amounts held under this Plan. By executing an Adoption <br /> Agreement, each participating Employer shall agree to accept the <br /> terms and conditions of Fund investments set forth herein and to <br /> invest all Deferrals and Transfers with respect to its Employees <br /> in the Fund. Except as otherwise authorized by the Board, Fund <br /> investments shall be restricted to participating Employers that <br /> have adopted this Plan. <br />
