10 . 7 Communications to Participants . All notices, <br /> statements, reports, and other communications from the Board or <br /> an Employer to any Employee, Participant, Beneficiary, or legal <br /> representative of any such person shall be deemed to have been <br /> duly given when delivered to, or when mailed by first class mail, <br /> to such person at his or her last mailing address appearing on <br /> the Plan records. <br /> 10 . 8 Time Periods : As necessary or desirable to <br /> facilitate the proper administration of the Plan and consistent <br /> with the requirements of section 457 of the Code, the Board may <br /> further restrict the time periods during which a Participant or <br /> Beneficiary is required to make any election under the Plan, <br /> including the making or amending of a Deferral Agreement, the <br /> making or amending of Investment Option selections, the election <br /> of distribution commencement dates or distribution forms . <br /> ARTICLE 11 - GENERAL PROVISIONS <br /> 11 . 1 Amendment : Subject to the requirements of the <br /> Government Code, the Board reserves the right at any time to <br /> amend or modify the Plan without the consent of any Employer, <br /> Participant, or Beneficiary. The Board shall give notice of any <br /> such amendment or modification to participating Employers . <br /> Except as may be required to maintain the status of the Plan as <br /> an Eligible Deferred Compensation Plan under section 457 of the <br /> Code or to comply with other applicable law, no amendment or <br /> modification shall impair any individual ' s right to benefits <br /> under the Plan or expand any Employer' s obligation to provide <br /> benefits with respect to amounts previously credited to <br /> Participants ' Accounts . <br />
