15.3.1.2 Any unit member who believes he/she has a grievance which is <br />an objection or challenge to any punitive disciplinary action shall <br />present the grievance orally to the Captain within ten (10) days <br />after the grievant knew, or reasonably should have known, of the <br />circumstances which form the basis for the grievance. Failure to <br />do so will render the grievance null and void. The Captain shall <br />hold discussions and attempt to resolve the matter within ten (10) <br />days after the presentation of the grievance. It is the intent of this <br />informal meeting that at least one personal conference be held <br />between the aggrieved employee and the Captain. <br />15.3.2 Level II - Formal Written Grievance <br />15.3.2.1 If the grievance is not settled during the informal conference and <br />the grievant wishes to press the matter, the grievant shall present <br />the grievance in writing on the appropriate form to the Chief of <br />Police within ten (10) days after the oral decision by the <br />immediate supervisor. The written information shall include: (a) <br />A description of the specific grounds of the grievance, including <br />names, dates, and places necessary for a complete understanding <br />of the grievance; (b) A listing of the provisions of this MOU <br />which are alleged to have been violated; (c) A listing of the <br />reasons why the immediate supervisor's proposed resolution of <br />the problem is unacceptable; and (d) A listing of specific actions <br />requested of the City which will remedy the grievance. <br />15.3.2.2 The Chief of Police shall communicate the decision to the <br />grievant in writing within ten (10) days after receiving the <br />grievance. If the Chief of Police does not respond within the <br />time limits, the grievant may appeal to the next level. <br />15.3.2.3 Within the above time limits either party may request a personal <br />conference. <br />15.3.2.4 Prior to determining the level of discipline to be taken on alleged <br />violations of City or Department rules and/or regulations, the <br />Chief or his designee will: <br />1. Ascertain if the represented employee wishes the <br />Association to intervene on their behalf prior to the decision <br />being made by the Chief as to level of discipline. <br />2. In those cases where intervention is not desired, the Chiefs <br />decision will be made without Association intervention. <br />29 <br />
