COpy 02/24/03 RESOLUTION NO. 14507 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AUTHORIZING ACQUISITION OF PROPERTY AND THE EXPENDING OF FUNDS THEREFOR, AND THE INSTITUTION OF EMINENT DOMAIN PROCEEDINGS ASSESSOR'S PARCEL NO. 052-366-040 (OWNER(S): James P. Celotti And Aida A. Celotti, as Trustees Linda Aal, Clifton Anderson, Andrea Anderson, Linda Aal, Custodian) WHEREAS, the Government Code of the State of California Sections 37350.5, 37353, and 40404, and Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, and 1240.120, et seq., provide for the acquisition of private property necessary to carry out any of the City's powers or functions and for the public use described herein; and, WHEREAS, the public interest and necessity require the acquisition of fee title to the real property hereinafter described above, for a public use, namely, for a public parking facility in the City of Redwood City (lithe Project"); and, WHEREAS, pursuant to the Code of Civil Procedure Section 1245.235, notice and an opportunity to be heard was given to the owner(s) of the property which is the subject of this Resolution as the person(s) shown on the last equalized county assessment role; and, WHEREAS, pursuant to Government Code Section 7267.2 the owner(s) of record was offered just compensation for the real property hereinafter described; and, WHEREAS, the public interest and necessity require the acquisition of the property hereinafter described on Exhibit "A", for a public use, namely, an underground public parking facility consisting of 590 parking spaces; and, WHEREAS, the City of Redwood City is authorized to exercise the power of eminent domain for the purpose of taking such property by virtue of Government Code Sections 37350.5, 37353 and 40404 and Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, and 1240.120; and, WHEREAS, the City of Redwood City has prepared and certified as complete the Final Environmental Impact Report and approved by Resolution the Addendum to the Environmental Impact Report as being in compliance with California Environmental Quality Act ("CEQA"), found in Public (n<>op 1 ....f.1) 1111111111111111111111111111111111111111111111111111111 2003-049837 02/26/2003 10:41~ R1 Page: 2 of 6 _...
