OIlGINAL AMENDMENT NO.2 TO AGREEMENT FOR HISTORIC PROPERTY PRESERVATION (423 Beech Street) This Amendment NO.2 by and between the City of Redwood City, a charter city and municipal corporation of the State of California (hereinafter referred to as "City") and Alison Ca~right and Jay Saber (collectively, "Owner"), is entered into and effective as of the ~ay of November, 2002, amending the Agreement dated February 7, 1992 (the "Agreement"), by and between the City and Mark Weir (the "Original Owner") for the preservation of an historic structure located at 423 Beech Street, Redwood City, California (the "Structure"). RECITALS WHEREAS, on July 10, 1995, the Agreement was amended related to replacement of the Structure's roof; and WHEREAS, subsequent to the effective date of the Agreement, as amended, the Original Owner transferred his interest in the Structure to Owner; and WHEREAS, pursuant to Paragraph 8 of the Agreement, as amended, all agreements, rights, covenants, reservations and restrictions contained in the Agreement as amended, are binding on and inure to the benefit of the original parties as well as their successors and assigns; and WHEREAS, Owner wishes to update the Agreement's scope of work and timeline to preserve the property; and WHEREAS, on September 12, 2002, the City's Historic Resources Advisory Committee considered the Owner's proposal to update the Agreement's scope of work and timeline to preserve the property and voted to recommend the amendments to the City Planning Commission for consideration; WHEREAS, on September 17, 2002, the City Planning Commission considered the Owner's proposal to update the Agreement's scope of work and timeline to preserve the property and voted to recommend the amendments to the City Council for approval. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Owner agree as follows: 1. The City consents to the Assignment of the Agreement, as amended, from Original Owner to Owner. 2.
