REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />September 25, 2017 <br /> <br />SUBJECT <br />Approval of the General and Special Release to Resolve Litigation Laszlo v. City of <br />Redwood City, et al. <br /> <br />RECOMMENDATION <br />By motion, approve and authorize the City Manager to execute the General and Special <br />Release in Laszlo v. City of Redwood City, et al. <br /> <br />BACKGROUND <br />This is a case by Nicholas Laszlo against the City for dangerous condition of public <br />property and Granite Rock Company for negligence. Mr. Laszlo alleges that he suffered <br />personal injuries and property damage as a result of a solo bicycle accident on <br />Blomquist Street on December 30, 2015. At the mediation held on August 15, 2017, the <br />parties reached a global settlement for $300,000, whereby the City would pay $135,000 <br />towards the settlement and Granite Rock would pay $165,000. These terms have been <br />memorialized in a General and Special Release signed by Mr. Laszlo and his attorney. <br /> <br />ANALYSIS <br />The City Attorney’s Office recommends approval of the settlement as delineated in the <br />General and Special Release. <br /> <br />ALTERNATIVES <br />Council could elect not to approve the settlement. <br /> <br />FISCAL IMPACT <br />The settlement proceeds will be withdrawn from the City’s general liability fund. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in the CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br /> <br />6.1.E. - Page 1
