ATTY/RESO.0090/CC RESO APPROVING & AUTHORIZING THE CITY MANAGER TO EXECUTE BRADFORD DDA <br />REV: 09-18-17 PR <br />Page 2 of 2 <br />the Developer are not necessary for City use and further are not “surplus land” as defined <br />therein. This determination is based on the following facts: <br />1. Under Section 2.42 C.2.a. of the Municipal Code, the disposition of the <br />City Property will secure certain community benefits, including construction and <br />operation of a childcare facility on the Project site and construction of a publicly- <br />accessible Creekside trail adjacent to Redwood Creek. <br /> <br />2. Under Section 2.42 C.2.c. of the Municipal Code, the disposition and <br />development of the Property serves a common benefit by allowing better and more <br />compatible uses, including affordable housing, childcare facilities, and publicly- <br />accessible open space, than its present use and will further the purposes of the <br />Downtown Precise Plan, through the provision of transit-oriented housing, removing <br />ongoing maintenance obligations associated with the Property, and community <br />benefits, also thereby implementing General Plan goals and policies. <br /> <br />Section 3. Disposition and Development Agreement: The City Council hereby <br />authorizes and directs the City Manager to execute the Disposition and Development <br />Agreement, subject to any minor, clarifying and conforming changes approved by the City <br />Attorney. The City Council further authorizes the City Manager to take all actions necessary <br />to carry out the Disposition and Development Agreement for the development of the Project. <br />Section 4.
