Item NO. 12 (continued) <br />7. A mitigated negative declaration was prepared for the <br />Project pursuant to the California environmental Quality Act <br />(•CROA•t Pub. Res. C. $21000 at seq.) and local regulations, <br />dated June 24, 1987. The negative declaration has been reviewed <br />and considered by the City Council, and each member thereof, <br />prior to making a decision on the appeal. <br />8. The mitigation measures included in the negative <br />declaration address the anticipated traffic volume from the <br />operation of the Project by requiring the Permittee to provide <br />for construction of: Whipple Avenue /north -bound Route 101 on -ramgp <br />intersection improvements, Veterans Boulevard and Whipple Avenue <br />intersection improvements, and traffic storage improvements on <br />East Bayshore Road in the vicinity of the Project site. Those <br />mitigation measures, among others, have been attached as <br />conditions to the use permit. <br />9. The toning Administrator, on the appeal, has <br />recommended the deletion of Condition No. a as specified in the <br />original use permit, the amendment of Condition No. 7 likewise to <br />specified, and the addition of a now condition, all as set forth <br />in the Report to the Honorable Mayor and City Council dated March <br />3, 1988 regarding the appeal. <br />30. The conditions attached to the use permit (including <br />those mitigation measures specified in the negative declaration), <br />as proposed for amendment and modification by the toning <br />Administrator in the aforesaid report, adequately address the <br />traffic congestion and flow anticipated to be generated or caused <br />by the Project, and this Council so finds. <br />il. The Project site is located in the *CG' (General <br />Commercial) zoning district (Ord.No. 1130, the stoning <br />Ordinance•, $1S.2 at sag.). The Project is a conditional use <br />permitted in that district (Zoning Ordinance 515.4di see, also, <br />iubdiv. a) . <br />12. The establishment, maintenance, or operation of the <br />Project will not, under the circumstances of this particular <br />case, be detrimental to the health, safety, peace, morals, <br />comfort, or general welfare of persons residing or working in the <br />neighborhood of the Project, nor will it be detrimental or <br />--- -Jnjurious =_pz oparty-_gr_impr0vements in the neighborhood, or to <br />the general welfare of the City in light of the mitigation <br />measures and conditions attached to the use permit because the <br />Project as permitted, and subject to said conditions is <br />consistent with the General Plan, the toning Ordinance, and <br />adequately addresses anticipated effects upon the environment. <br />13. The use permit, subject to the conditions as amended <br />and modified on appeal, should be granted, and the appeal denied. <br />The foregoing findings, determinations and conclusions were <br />approved by the Council of the City of Redwood City at a regular <br />meeting held on !larch 21, 1988 by the following vote: <br />AM, mad in favors Councilmen Britschgi, Chandler.
