Item No . 2 (continued) <br />Joel Patterson, Planning Director presented background information on density <br />and duplexes in the Friendly Acres area, and distributed copies of minutes of <br />October 10, 1983 showing Council upholding "decision of the Zoning <br />Adni nistrator that the variance procedure cannot be used to 'legalize' a <br />zoning violation and that residential densities cannot be increased by means <br />of variances ". <br />Mayor Greenalch declared the public hearing open at 7:45 p.m. <br />Jon Del agnes and Kim Del agnes, appellants, stated the property was zoned R -2 <br />when purchased, 90% of buildings in area are duplexes, their designs meet all <br />set back requirements, provide a 3 -car garage and a carport, and provide much <br />needed affordable housing. <br />M /S: Stangel /bury to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8:05 p.m. <br />Council expressed concerns over approving variances creating higher densities <br />and also setting a precedent in similar appeals; but also, the need for more <br />housing, the fact that an addition to this house using the same square feet <br />would be acceptable but a duplex is not, the design includes adequate <br />parking, the neighborhood is zoned for duplexes, and expressed a desire <br />not to create a hardship on these appellants. <br />M /S: Stangel /Murray to approve the appeal of the denial by the Zoning <br />Administrator of an application for a variance to allow construction of a <br />duplex at 978 Haven Avenue. <br />AYES: Councilmen Buchan, Bury, LaBerge, Murray, and Stangel <br />NOES: Councilman Claire and Mayor Greenalch <br />City Attorney to prepare f ndi ngs to be presented at May 9, 1988 Counci 1 <br />meeting. <br />MINUTE ORDER NO. 88 -64 <br />---------------------------------------------------------------------------------- <br />3.
