6.1.F. - Page 9 <br />15. Insurance. During the term of this Agreement, LICENSEE shall maintain, or require any <br />of its contractors and subcontractors, agents and representatives for the Project to maintain, the <br />following insurance coverages listed below. Insurers shall have a minimum A.M. Best's rating of <br />not less than "A -VII": <br />A. Liabilitv Insurance. Occurrence -based commercial general liability insurance with <br />coverage at least as broad as Insurance Services Office (ISO) form CG 00 01 covering <br />general aggregate, for third party bodily injury, personal injury, and property damage, <br />including injury or damage arising out of pollution, with limits not less than $2,000,000 for <br />each occurrence and $4,000,000 annual aggregate. General liability policies shall be <br />primary and non-contributory, and be endorsed using Insurance Services Office form CG <br />20 10 to provide that City and its officers, officials, employees, and agents shall be <br />additional insureds under such policies. An endorsement providing completed operations <br />to the additional insured, ISO form CG 20 37, is also required. General Liability policy <br />must include a Riggers Liability endorsement that effectively deletes the care, custody or <br />control exclusion. <br />B. Automobile Liabilitv Insurance. Automobile liability insurance policy with a minimum <br />limit of not less than $1,000,000 per accident. Coverage shall be applicable to all owned, <br />hired or non -owned vehicles placed, parked or used by and under the control of <br />LICENSEE or its contractor(s), subcontractors, consultants, employees, officers, agents <br />and invitees using ISO Business Auto Coverage form CA 00 01, or the exact equivalent. <br />C. Workers' Compensation and Emolovers' Liabilitv. Workers' compensation policy <br />written in accordance with the laws of the State of California that includes a waiver of <br />subrogation in favor of the City, its officers, agents, employees, and volunteers. This <br />policy shall include Employer's liability coverage with limits not less than $1,000,000 per <br />occurrence. <br />D. Other. <br />1) The minimum limits of insurance coverage required of LICENSEE under this <br />Agreement shall in no event limit the liability of LICENSEE under this Agreement. <br />LICENSEE shall deliver to CITY evidence of the coverage required hereunder on or <br />before the Effective Date, and delivery of such evidence shall be a prerequisite to <br />and condition of LICENSEE's right to use the License Area pursuant to this <br />Agreement. <br />2) All insurance required above, shall provide the CITY 30 days written notice in the <br />event of cancellation. <br />3) Prior to the Commencement Date, LICENSEE shall deliver to CITY certificates of <br />insurance and additional insured endorsements in a form reasonably satisfactory to <br />CITY, evidencing the coverages required hereunder. <br />4) LICENSEE's compliance with the provisions of this Section shall in no way <br />relieve or decrease LICENSEE's indemnification obligations under this Agreement <br />or any of LICENSEE's other obligations hereunder.
