6.1.F. - Page 9 15. Insurance. During the term of this Agreement, LICENSEE shall maintain, or require any of its contractors and subcontractors, agents and representatives for the Project to maintain, the following insurance coverages listed below. Insurers shall have a minimum A.M. Best's rating of not less than "A -VII": A. Liabilitv Insurance. Occurrence -based commercial general liability insurance with coverage at least as broad as Insurance Services Office (ISO) form CG 00 01 covering general aggregate, for third party bodily injury, personal injury, and property damage, including injury or damage arising out of pollution, with limits not less than $2,000,000 for each occurrence and $4,000,000 annual aggregate. General liability policies shall be primary and non-contributory, and be endorsed using Insurance Services Office form CG 20 10 to provide that City and its officers, officials, employees, and agents shall be additional insureds under such policies. An endorsement providing completed operations to the additional insured, ISO form CG 20 37, is also required. General Liability policy must include a Riggers Liability endorsement that effectively deletes the care, custody or control exclusion. B. Automobile Liabilitv Insurance. Automobile liability insurance policy with a minimum limit of not less than $1,000,000 per accident. Coverage shall be applicable to all owned, hired or non -owned vehicles placed, parked or used by and under the control of LICENSEE or its contractor(s), subcontractors, consultants, employees, officers, agents and invitees using ISO Business Auto Coverage form CA 00 01, or the exact equivalent. C. Workers' Compensation and Emolovers' Liabilitv. Workers' compensation policy written in accordance with the laws of the State of California that includes a waiver of subrogation in favor of the City, its officers, agents, employees, and volunteers. This policy shall include Employer's liability coverage with limits not less than $1,000,000 per occurrence. D. Other. 1) The minimum limits of insurance coverage required of LICENSEE under this Agreement shall in no event limit the liability of LICENSEE under this Agreement. LICENSEE shall deliver to CITY evidence of the coverage required hereunder on or before the Effective Date, and delivery of such evidence shall be a prerequisite to and condition of LICENSEE's right to use the License Area pursuant to this Agreement. 2) All insurance required above, shall provide the CITY 30 days written notice in the event of cancellation. 3) Prior to the Commencement Date, LICENSEE shall deliver to CITY certificates of insurance and additional insured endorsements in a form reasonably satisfactory to CITY, evidencing the coverages required hereunder. 4) LICENSEE's compliance with the provisions of this Section shall in no way relieve or decrease LICENSEE's indemnification obligations under this Agreement or any of LICENSEE's other obligations hereunder. Notwithstanding anything to the contrary in this Agreement, this Agreement shall terminate immediately, without notice to LICENSEE, upon the lapse of any required insurance coverage.
