<br /> ARTICLE II <br /> SURVEYS AND STUDIES <br /> Section 2.1. Deliverables. Within the applicable time periods specified below, Landlord <br /> shall at its sole cost and expense furnish Tenant, for Tenant's review and approval, the following <br /> documentation: <br /> (a) Survev. Within thirty (30) days after the Effective Date, a current <br /> ALTAlACSM "Urban" class land title survey of Landlord's Parcel showing, without <br /> limitation, the topography, easements, existing buildings, existing utilities and <br /> restrictions, if any, on or affecting Landlord's Parcel. Such survey shall be prepared by a <br /> surveyor selected by Landlord and approved by Tenant. Such surveyor shall be licensed <br /> in the jurisdiction which the Premises are located. The survey shall be certified to Tenant <br /> by the surveyor. <br /> (b) Environmental Reports. Within thirty (30) days after the Effective Date, a <br /> copy of each environmental report pertaining to the Center and in Landlord's possession <br /> and control, which shall be certified to Tenant within sixty (60) days after the Effective <br /> Date and shall confIrm that all hazardous materials present within the Center in violation <br /> of Applicable Laws have been removed to a level acceptable to all applicable regulatory <br /> agencies and that all other recommended environmental remediation work set forth in the <br /> Existing Environmental Report has been satisfactorily completed. <br /> (c) Entitlements. Within one hundred twenty (120) days after the Effective Date <br /> (or, if Landlord's Work contemplated hereunder is already entitled, within ten (10) <br /> business days after the Effective Date), Landlord shall obtain (and shall provide to <br /> Tenant) a full set of all documents showing that Landlord has received design review <br /> approval (if required) and the building permits for the construction of Landlord's Work <br /> (excluding the design review approval and building permits for Tenant's Work, which <br /> shall be Tenant's responsibility to obtain). <br /> (d) Other Approvals. Within one hundred eighty (180) days after the Effective <br /> Date, except for the building permit for the construction of Tenant's Work and any other <br /> governmental approvals required to be obtained by Tenant pursuant to the Lease, <br /> Landlord shall provide to Tenant evidence that Landlord has obtained all other approvals <br /> necessary for the development and operation of the Center (including the Premises). <br /> Such approvals shall include (without limitation) all approvals needed from adjacent <br /> landowners, approvals needed under reciprocal easement agreements and other recorded <br /> restrictions, under existing leasehold agreements or from lenders. <br /> Section 2.2. Tenant's Review of Reports. Upon receiving such survey, reports and <br /> other documentation, Tenant shall have thirty (30) days to review such documentation. In <br /> connection with its review, Tenant shall have the right to contact the companies that prepared the <br /> document and to discuss and verify the findings. To the extent such documents are incomplete <br /> or unsatisfactory, Tenant shall provide a written notice to Landlord stating the deficiencies. <br /> CHG02:3091375.v8 <br /> . ..-....-.....-- <br />
