<br /> the date Tenant obtains the Tenant Permit, to terminate this Lease by written notice to <br /> Landlord. In the event that Tenant does not terminate this Lease as permitted in this <br /> paragraph, within five (5) business days of written notification from Tenant that a <br /> revision is needed, Landlord shall revise Landlord's Plans (and the affected portions of <br /> Landlord's Work) at no costto Tenant to accommodate the entitlements for the Project or <br /> conditions to obtain the Tenant Pennits. If and to the extent that Tenant is required to <br /> modify Tenant's Plans or Tenant's Work to accommodate changes in Landlord's Plans or <br /> Landlord's Work after Landlord has approved Tenant's Plans, then Landlord shall pay to <br /> Tenant all increased costs incurred by Tenant resulting from such modifications. <br /> Section 3.3 Landlord's Plans. Not later than one hundred twenty (120) days after the <br /> Effective Date, Landlord shall submit to Tenant for its approval, which shall not be unreasonably <br /> withheld (provided that such plans and specifications are consistent with, and represent a logical <br /> design and engineering progression of the Site Plan, the approved architectural renderings and <br /> Tenant's floor plans for the Premises), proposed concept plans for the Building (upon approval <br /> by Tenant, "Landlord's Concept Plans"), which shall be consistent in all material respects with <br /> the Site Plan and architectural rendering attached hereto as Exhibits D-l and D-2, respectively, <br /> and with the proposed floor plans for the Premises as furnished by Tenant pursuant to Section <br /> li above. Within thirty (30) days of the receipt of these plans, Tenant shall either approve or <br /> disapprove, in writing, the plans. Any disapproval must state the specific reason( s) for such <br /> disapproval. If Tenant gives notice of its disapproval as above provided, and the parties are <br /> unable to agree upon Landlord's Concept Plans within thirty (30) days after Tenant's receipt of <br /> Landlord's proposed version of same, Tenant may terminate this Lease by giving notice to <br /> Landlord and neither party shall have any further obligations to the other, except as otherwise <br /> provided in this Lease. <br /> Within one hundred twenty (120) days after Tenant's approval of Landlord's Concept <br /> Plans, Landl0fd . shall-submit to Tenant for its approval, which shall not be unreasonably <br /> withheld (provided that such plans and specifications are consistent with, and represent a logical <br /> desi~_~~_ engin~eriEg progression of Landlord's Concept Plans and Tenant's Preliminary <br /> ".0..______ Plans), so-called fifty percent (50%) plans and specifications for the Building (upon approval by <br /> Tenant, "Landlord's 50% Plans"). Landlord's 50% Plans shall incorporate and be consistent <br /> with Tenant's Preliminary Plans. Within thirty (30) days after Tenant's receipt of such plans and <br /> specifications, Tenant shall, by giving notice to Landlord, either approve such plans and <br /> specifications or disapprove same and specify in detail the reasons for such disapproval. If <br /> Tenant gives notice of its disapproval as above provided, and the parties are unable to agree upon <br /> Landlord's 50% Plans within thirty (30) days after Tenant's receipt of Landlord's proposed <br /> version of same, Tenant may terminate this Lease by giving notice to Landlord and neither party <br /> shall have any further obligations to the other, except as otherwise provided in this Lease. <br /> Within one hundred twenty (120) days after Tenant's approval of Landlord's 50% Plans, <br /> Landlord shall submit to Tenant for its approval, which shall not be unreasonably withheld <br /> (provided that such plans and specifications are consistent with, and represent a logical design <br /> and engineering progression of Landlord's 50% Plans and Tenant's Final Plans), so-called one <br /> hundred percent (100%) plans and specifications for the Building (upon approval by Tenant, <br /> "Landlord's Plans"). Landlord's 100% Plans shall incorporate and be consistent with Tenant's <br /> CHG02:3091375.v8 <br /> . _....,..,.~..... <br />
