D. Developer acknowledges that different or additional facts may be discovered in addition to what it now knows or believes to be true with respect to the matters herein released, and that it agrees that this release shall be and remain in effect in all respects as a complete and final release of the matters released, notwithstanding the discovery of any different or additional facts. 12. New: A new section is added to the Agreement, as follows: Section 26 - Review by Counsel. Developer expressly represents that it has consulted with its attorneys, or has had the opportunity to do so, with respect to the settlement and compromise of claims for compensation under the Agreement, and that by signing this Amendment, Developer is giving up the opportunity to assert or pursue Claims against City or Agency arising from or related to Change Order Requests 1 though 86 and delays in the Project arising from or related to events occurring prior to the date this Amendment is signed, whether or not Developer, City or Agency has been notified of the delay or Claim.
