Item No. 17. (continued out of order) <br />There being no objection, Mayor Greenalch ordered that item 17. be considered <br />out of order at this time. <br />Community Development Director Pawloski presented the subject information <br />report using slides of the exhibits in the Appendix. <br />Aaron Hayes, property owner of Lots 16, 17 and 18 on Laurel Way, distributed <br />photography of the property, stating he wishes to build three homes on the <br />lots and does not believe poor soil conditions exist on his property and that <br />he would be able to meet all Code requirements. <br />Pat Fellowes, builder and developer for Mr. Hayes, said that he believes the <br />Hayes lots are buildable both economically and because the lots are not as <br />steep as others in the neighborhood. Mr. Fellowes said that all infra- <br />structure for the lots is in place. <br />In response to questions, Mr. Hayes said he does not believe an environmental <br />impact report is needed and that his property is about 50,000 sq. ft. <br />In response to question, Planning Director Patterson said that the property <br />involved is only about 27,000 sq. ft and is subject to slope density <br />requirements. <br />In response to question, City Attorney Schricker said that City liability <br />could be substantial if building permits were issued and the houses later <br />slipped; and stated that with regard to Mr. Hayes' use of "grand fathered" <br />lots, that the lots remain as subdivided before annexation from the County to <br />the City so the subdivided lots are "grand fathered ", but that City zoning and <br />slope density requirements prevail now. <br />Violet Hayes, 719 Crescent Avenue, San Mateo, inquired as to the portion of <br />Laurel Way which is paved and asked to be allowed to apply for a building <br />permit. <br />CONSENSUS: Mayor Greenalch determined it to be the consensus of Council that <br />Council will proceed with regard to future development of Laurel Way as <br />outlined in the Report of the Community Development Director of September 1, <br />1988 with staff authorized to proceed accordingly. <br />City Manager Smith stated for the record that an environmental impact report <br />will be expected to be a joint effort with the property owners who wish to <br />develop property on Laurel Way. <br />M EM 0 9/13/88 <br />---------------------------------------------------------------------------- - - - - -- <br />CITY MANAGER REPORTS <br />10.
