Frani: & Co., a corporation. relative <br />to the acquisition by said Town of the'' <br />Peninsula Wharf and Warehouse prop - <br />Orly from said S. TI. Frani: & Co, and <br />the construction of a spill' tract: by! <br />said Town from Chestnut street to' <br />said wharf property under the terms <br />anti conditions in said agreement pro- <br />vided, whieb agreement is now on <br />file with the First National Bank of; <br />San Matoo County in escrow. a copy; <br />thereof being on file in the office of tile' <br />Clerk of said Town of Redwood,CitY; i <br />and Whereas, under and Pursuant to <br />the terms of said agreement said S. TI. <br />Frank & Co, executed and deposited in <br />escrow with said above named bank, a <br />deed of said Peninsula Wharf and <br />Warehouse property to said Town of <br />Redwood City, said deed to be deliver- <br />ed upon tine completion of the con- <br />ditions by said Town of the terms of <br />said escrow agreement; and Whereas, <br />subsequent to the placing of said deed <br />and said agreement in escrow said <br />Town of Redwood City took up with <br />said S. II. Frank & Co. the question of <br />changing said deed so that same would <br />convey said above mentioned Wharf <br />property to said Town in fee free ands <br />clear of tine conditions relating to re- <br />version now in said deed; and <br />Whereas, on the 27th day of Septem- <br />ber, 1920, said Town of Redwood City <br />received from said S. H. Frank & Co. <br />a written communication wherein said <br />S. H. Frank & Co. refused to make any, <br />change in the present escrow deed' <br />and agreement and asked said Town of <br />Redwood City to pass the necessary <br />,resolutions releasing said escrow and <br />turning back to them said wharf prop- <br />] arty; and <br />Whereas, said Board of Trustees' <br />deems that it is for the best interests <br />of said Town of Redwood City to re- <br />lease said escrow as requested by S. <br />It. Frank & Co. rather than to go <br />through with same under the coil-, <br />'ditions now in said deed and agree -'i <br />ment; <br />Now Therefore be it Resolved by the <br />Board of Trustees of the Town of Red- <br />wood City, that at the request and with <br />the consent of S. 1-I. Frank & Co. a cor-' <br />po•atiou, the escrow agreement here-! <br />tofo'e made between said S. H. Frank <br />& (''o., a corporation and said Town of <br />Redwood City, dated April 3rd, 1920,! <br />and the deed thereafter made by soldh <br />S. H, Frank & Co., it corporation in <br />Pursuance of said agreement, said es- <br />crow, agreement and deed now beingf <br />in possession, under said escrowi <br />agreement, of the h'irst National <br />Bunk of San Mateo County, be and the <br />same are released and cancelled and <br />made of no force and effect. <br />,And be it Further Resolved that <br />said First rational Bank of Son Mateo <br />County, the escrow holder of said <br />agreement and decd be and they are <br />hereby requested and direcleil to re- <br />turn to said S. IT. Frank & Co., a cor- <br />poration, said escrow agreement and <br />deed herebefore mentioned and des- <br />cribed. <br />And be it Further Resolved that n <br />certified copy of this Resolution be <br />given to the S.
