<br />ORDINANCE NO. 226
<br />GRANTING PERMISSION TO THE
<br />CITY AND COUNTY OF SAN FRAN-
<br />CISCO TO CONSTRUCT AND MAIN-
<br />TAIN WATER CONDUITS ACROSS
<br />CERTAIN STREETS IN TIE TOWN
<br />OF REDWOOD CITY, IN CONNEC-
<br />TION WITH ITS HETCIC HETCHY
<br />WATER SUPPILY PROJECT, AND
<br />PRESCRIBING THE TERMS ,AND
<br />CONDITION OF SUCH GRANT.
<br />The Board of Trustees of the Town
<br />of Redwood City do ordain as follows,
<br />to -Wit:
<br />SECTION 1. In accordance with the'
<br />provisions of the Acts of the Legisla-i
<br />Lure of the State of California, of Mayi
<br />4, 1015 (found in the Statutes of 1915,
<br />Page 345) and of March 7, 1011 (found
<br />in the Statutes of 1911, page 300), and
<br />in compliance with the request in writ-
<br />ing received from thea Board of Super-
<br />visors of the' City and County of San
<br />Francisco,.a municipality, .permission
<br />Is hereby granted to Bald City and
<br />„County of San Francisco to construct
<br />j 1 and maintain a water conduit or con-
<br />duits, In connection with its Hetch
<br />Hetohy Water Supply project, In and
<br />across the following named streets in
<br />said Town of Redwood City, to -wit:
<br />Redwood Avenue,
<br />I- Ebener Street, formerly known as
<br />Wood Street,
<br />Oak Avenue,
<br />Hudson Street, formerly ]mown as
<br />'Wallace Street,
<br />Roosevelt Avenue,
<br />Bing Street, formerly ]mown as Ken-
<br />dall Street,
<br />Dickey Street,
<br />Vera Avelrue,
<br />Hawes Street, formerly known as
<br />Lowell Street,
<br />Madison Avenue,
<br />Myrtle Street,
<br />Sefferson Avenue;
<br />Avenue Del Ora,
<br />TpPaz 'Street,
<br />Foothill Boulevard,
<br />Canyon Road.
<br />SECTION 2. The Permission above
<br />granted Is subject to the following
<br />terms and conditions, viz.:
<br />1. That the City and County of San
<br />Francisco shall -restore all roads,
<br />streets and avenues intersected by its
<br />aqueduct or conduit to their former
<br />state of usefulness, with the least Pos-
<br />sible delay, after completing- construe -
<br />tion thereon, and shall restore the
<br />pavement and curbs and sidewalks
<br />which have been cut, to the satisfaction
<br />of the Superintendent of Streets of said
<br />Town of Redwood, City.
<br />2. The grantee shall maintnin suit-
<br />able bypasses for tratfie during the
<br />period that any street shall be open or
<br />unsafe for traffic during such construc-
<br />tion, and shall assume all ]lability for
<br />damages or Injury to Persons or prop-
<br />erty resulting from accidents decas-
<br />iloned by such construction.
<br />3. That the grantee In construct -
<br />Ing the water conduit or conduits in
<br />and *across the hereinbefore named
<br />streets shall construct same under all
<br />sewer, water or other Pipes now In
<br />place In said streets, and If any sewar,
<br />water or other pipes are Injured In the
<br />construction of said conduits tbey'shall
<br />Immediately be restored to their form-
<br />er state uf'usefulness by said grantee
<br />at Its expense.
<br />4. That the said grantee permit the
<br />Town of Redwood City to establlBh
<br />connection with said conduit or con-
<br />duits for its municipally ,owned water
<br />system, such connection to be of a de-
<br />sign approved by the engineers of both
<br />the Town of Redwood City and the
<br />City and County of San Francisco, and
<br />when said grantee carries Its own wat-
<br />er through the said conduit or conduits
<br />to be constructed in and across the
<br />hereinbefore named streets, it will fur-'
<br />nish water to the Town of, Redwood
<br />City, at a Price to be agreed upon be-
<br />tween said Town, and said gran-
<br />tee or as fixed by the Railroad COmpils-I
<br />sion of the State of California, in the
<br />event agreement cannot be reached.
<br />I$ECTION 3. This Ordinance shall
<br />be published once In the Redwood City
<br />'Standard, a weekly newspaper pub-
<br />lished, Printed and circulated in said
<br />Town of Redwood City, and shall talc
<br />effect and be in farce from and after
<br />Its passage.
<br />Introduced April 24th, 1922.
<br />Passed and adopted as an Ordinance
<br />of the Tdwn of Redwood: City by the
<br />Board of Trustees of said Town at a
<br />regular meeting of sold Board held on
<br />the at day ori blah-, 1922, by tho fol-
<br />lowing vote:
