<br />Section 69. PROVISIONS TO BE
<br />INSERTED IN ALL CONTRACTS:
<br />Every contract for work to be
<br />performed within the State of I
<br />California nt the expense of the
<br />City or paid for out of moneys de-
<br />posited in the Treasury, whether
<br />such work Is to be done within
<br />or outside the corporate limits of
<br />Redwood City, and whether such i
<br />work be done directly by or under
<br />such contract drily awarded, or in-
<br />directly by or under subcontract,
<br />subpartnership, day labor, station'
<br />work, piece work, or any other
<br />arrangement whatsoever, most pro-
<br />vide:
<br />(1) That, in the performance
<br />of the contract, eight hours shall
<br />be the maximunn hours of labor on
<br />any calendar day, and that the
<br />minimum wages or compensation
<br />of persons performing labor in the
<br />execution of such contract, sub-
<br />contract, subpartnership, tl a y
<br />labor, station work, piece work, or
<br />other arrangement, shall be the
<br />prevailing scale of wages recog-
<br />i nized in the community for like
<br />work;
<br />(2) That any person perform-
<br />ing labor in the execution of such
<br />contract shall be a citizen of the
<br />United States or have declared
<br />his intention of becoming such;
<br />(3) That preference in the per-
<br />formance of labor under such
<br />contract or other arrangement
<br />shall be given to persons who
<br />shall have actually resided in Red-
<br />wood City and shall have so re-
<br />sided for the period of one year
<br />next preceding the date of their
<br />engagement to perform labor
<br />thereunder. The foregoing pro-
<br />visions designated (1), (2), and
<br />(3) must also apply to persons
<br />performing labor inn the conmis'
<br />sary or other auxiliary department
<br />of labor conducted in the course l
<br />of the execution of such contract'
<br />or any part thereof; and the sold
<br />provisions shall also apply in any'
<br />work done for or by Redwood City
<br />or by any officer, board or com-
<br />mission thereof, when such wort
<br />is to be done at the expense of
<br />Redwood City or paid for out of',
<br />moneys deposited fu the Treasury.,
<br />Any contract for work to be per-
<br />formed under the provisions of
<br />this Section which does not com-
<br />ply with the provisions thereof
<br />shall be mill and Told, slid any
<br />officer who shall sign the same'
<br />shall be deemed guilty of inis-
<br />feasauce and, upon Proof of such
<br />misfeasance, shall be removed
<br />front office.

<br />ATISCELLANEOUS
<br />Section 71. GENERAL LASVS
<br />APPLICABLE: All general laws
<br />of the state applicable to munlel-
<br />pal corporations, including thosei
<br />relating to "municipal affairs,'
<br />now or hereafter enacted, and
<br />which are not in conflict with the
<br />provisions of this charter or with
<br />ordinances or resolutions here-
<br />after enacted, shall be applicable
<br />to the city.
<br />Section 71 DEFINITIONS:
<br />Whenever In this charter the
<br />word "City" occurs, it nneaus Red-
<br />wood Cita'; and every department,
<br />board or officer, whenever either
<br />Is mentioned, means a department,
<br />board, or officer, as the case may
<br />be, of Redwood City. Whenever in
<br />this charter, the word "State"
<br />occurs, it means the Slate of Cali -
<br />fertile. Whenever the term 'Gen-
<br />eral Laws" is used herein, it
<br />means General Lawsrof'this State.
<br />Section 73. OFFICE VACATED:
<br />If any officer of the city shall
<br />remove front the city, or absent
<br />himself therefrom for more than
<br />30 days consecutively without the
<br />permission of the council, or if
<br />lie shall fall to qualify by taking
<br />the oath of office and filing his
<br />official bond, whenever such bent]
<br />is required, within 15 days from
<br />the time Ills certificate of election
<br />or appointment is mailed or de-
<br />livered to him, or if he shall re-
<br />sign, or if he shall be convicted
<br />yf felony, or if he slrall be ad -
<br />improvement, widening, extending,
<br />opening and closing of streets or
<br />rights of way owned by said City
<br />or in which said City has an case-
<br />ment, whether within or without
<br />the limits thereof, and the plant-
<br />ing of trees thereon, and the
<br />making of any other improve:
<br />meats authorized by the laws of
<br />the State, may be done and as-
<br />sessments therefor may be levied
<br />In conformity with and under the
<br />authority conferred by the general
<br />laws of the State now in effect or
<br />which may hereafter be enacted;
<br />provided, however, that the Coun-
<br />cil may by ordinance adopt a
<br />procedure for the Improvement
<br />of streets, alloys, rights of way
<br />or other Public places, the laying
<br />of pipe and conduits and the
<br />remo•ai front buildings, lots, and
<br />grounds, And the sidewalks op-
<br />posite thereto, of dirt, rubbish,
<br />weeds and other rank growth and
<br />materials which may injure or
<br />endanger neighboring property or
<br />the health or welfare of the in-
<br />habitants of said City, and for
<br />malting and enforcing assessments
<br />against the property benefited or
<br />affected thereby or from which
<br />such removal Is made for the
<br />cost of such improvements or re-
<br />moval, and may make such as-
<br />sessments a lien on such prop-
<br />erty superior to all other claims
<br />or liens thereon except state,
<br />county, and municipal taxes, but
<br />no such ordinance shall prevent
<br />or limit the Council from proceed-
<br />ing• under ally of the general
<br />laws of the State now in effect
<br />o• which may be hereafter enacted,
<br />referring to said purposes. It
<br />is the intention of this Charter
<br />to Permit the Council of said
<br />City to proceed In all matters re-
<br />ferred to in this section under
<br />the general laws of the State
<br />now In effect or hereafter to be
<br />enacted.
<br />Section 75. BOOKS AND REC-
<br />ORDS TO SUCCESSORS: All of-
<br />ficers and boards shall deliver to
<br />their successors all papers, books,
<br />documents, records, archives and
<br />other properties pertaining to
<br />their respective offices or depart-
<br />ments, in their possession or un-
<br />der their control.
<br />Section 76. CITIZENSHIP AND
<br />RESIDENC'E:- All officers, clerics,
<br />and assistants of the city and de-
<br />partments thereof, except such as
<br />may be employed for special pur-
<br />poses, must be citizens of the
<br />United States and residents of
<br />Redwood City during their period
<br />of -employment.
<br />Section 77. OFFICERS SHALL
<br />HAVE NO PERSONAL INTER-
<br />EST IN PUBLIC CONTRACTS:
<br />No member of the council, or of
<br />any hoard,. and no officer or em-
<br />ploye of the city shall be or be-
<br />come directly or indirectly Inter-
<br />ested in any contract, wok or
<br />business, or in the sale of any
<br />ardelb, the expense, price or con-
<br />sideration of which is Payable
<br />from the city treasury, nor shall
<br />either or any of them receive
<br />any gratuity or advantage from
<br />any contract or person furnishing
<br />labor or material for the same;
<br />and any contract with the city
<br />In which any such officer or em-
<br />ploye is or becomes interested
<br />shall be declared void by the
<br />council.
<br />Section 75. NO PAYMENT FOR
<br />OFFICE! No officer or employe
<br />of the city shall give or promise
<br />to give to any person any portion
<br />of his compensation, or any mon-
<br />ey or thing of value in considera-
<br />tion of having been, or of being
<br />nominated, appointed, voted for
<br />or elected to any office or em-
<br />ployment.
<br />Section 79. NO CONTRIBU-
<br />TIONS FOR EMPLOYMENT: Aro
<br />officer or employe slrall iiecept
<br />any donation or gratuity in mon-
<br />ey, or other thing of value, either
<br />directly or indirectly, from any
<br />subordinate or employe, or from
<br />any one under his charge, or from
<br />any candidate or applicant for
<br />any position as employe or sub-
<br />ordinate in, any department of the
<br />city.
<br />Section 80. NO FAVORITISM
<br />IN PUBLIC CONTRACTS: No of-
<br />ficer or employe of the city shall
<br />aid or assist a bidder in securing
<br />a contract to furnish labor, or
<br />material or supplies at a higher
<br />price or rate than that Proposed
<br />by any other bidder, or shall fa-
<br />vor one bidder over another, giv-
<br />ing or withholding Information,
<br />or shall willfully mislead any bid-
<br />der in regard to the character of
<br />the material or supplies called
<br />for, or shall knowingly accept
<br />materials or supplies of a quality
<br />inferlor to that called for by the
<br />contract, or shall knowingly cer-
<br />tify to a greater amount of labor
<br />performed than has actually been
<br />performed, or to the receipt of a
<br />greater amount of material or
<br />supplies than has actually been
<br />received.
<br />Section 81, FORFEITURE OF
<br />OFFICE FOR FRAUD: Every of-
<br />ficer who shall willfully approve,
<br />allow, or Pay any demand on the
<br />treasury not authorized by law,
<br />shall be liable to the city indl-
<br />vidually and on his, official bond,
<br />for the amount of the demand so,
<br />approved, allowed, or paid, and
<br />shall forfeit such office and be
<br />forever disbarred and disqualified
<br />from holding any position in the
<br />service of the city.
<br />Section 82, DISPOSITION OF
<br />PUBLIC MONEYS: All city offi-
<br />cials, and employes empowered to
<br />collect money for fees, permits, ]!-
<br />causes, inspection, services, taxes,
<br />or other municipal charges, shall
<br />collect the same promptly at the
<br />time they become due, turn them
<br />into the city treasury' daily, ob-
<br />tain a receipt therefor, and report
<br />the same to the city auditor week-
<br />ly- All such moneys and all fines
<br />or pecuniary penalties or forfeit-
<br />ures which may accrue to the
<br />city, and all funds which may re-'
<br />main fn the Possession of the city
<br />unclaimed after a period of -one
<br />year from the date when dine and
<br />payable, slrall be rlredited to the
<br />General Fund of the city, and
<br />shall be applicable to any pur-
<br />pose to. which the Council may
<br />appropriate them, and the coun-
<br />cil shall appropriate from this
<br />fund whatever sum may be nec-
<br />essary to pay valid claims of
<br />more than one year's standing.
<br />-Section 83. PUBLIC RECORDS:
<br />All books and records of eyery
<br />office and department shall be
<br />open to the inspection of •army
<br />citizen during business hours, sub-
<br />ject to the proper rules and regu-
<br />lations for the efficient conduct
<br />of the business of such depart-
<br />ment or office; but the records
<br />of the police department shall not
<br />be subject to such inspection ex-
<br />cept by permission of the proper
<br />police authorities.
<br />Section 84. COPIES OF REC-
<br />ORDS: Copies or extracts, duly
<br />certified, from said books and
<br />records open for inspection, small
<br />be given by the officer having
<br />the same in custody to any person
<br />demanding the same and paying
<br />or tendering ten cents per folio
<br />of one hundred words for such
<br />copies or extracts, and the addi-
<br />tional sum of fifty (50) cents for
<br />certifying.
<br />Section 85. OLD ORDINANCES
<br />IN EFFECT: All ordinances and
<br />resolutions in force at the time
<br />this charter takes effect, and not
<br />Inconsistent therewith, shall con-
<br />tinue in full force until amended
<br />or repealed.'
<br />Section 86. CONTINUING OFFI-
<br />CERS AND EMPLOYEES: Except
<br />as otherwise provided herein, the
<br />term of all elective officers and
<br />of all appointive officers elected
<br />or appointed under the form of
<br />government preceding this Char-
<br />ter shall terminate upon the rati-
<br />fication of this Charter by the
<br />Legislnture of this State; the in-
<br />cumbents of such offices slrall
<br />thereafter hold their respective
<br />offices until removed therefrom
<br />by the Council or the Commission,
<br />Board, or Officer to whom the
<br />power of removal of such officer
<br />Is hereby committed. All depu-
<br />ties, police officers, firemen and
<br />other employees of the City at the
<br />time of this Charter becoming'
<br />effective shall continua in their,
<br />respective offices or positions of
<br />employment, subject to rontovall
<br />` and the control thereof by the,
<br />t City Manager as here' provided.i
