<br />(e) The proposition or proposal to amend the Charter of the City of
<br />Redwood City by the addition thereto of new sections to be numbered as follows, to -sit:
<br />Section 47, Section 47a, Section 47b, Section 470, Section 47d, Section 47e,
<br />Section 47f,9do Section do Section 47h, Section 49, Section 4ga, Section 49b, Section
<br />48c, Section 48d, Section 49e, Section 49f, Section 48g, Section 49, Section 49a,
<br />Section 49b, Section 49c, Section 49d, Section 49e, Section 50 and Section 50a, to
<br />read as follows, to -wit:
<br />SLeLlen 47. ESTABLISHMENT
<br />OF A PORT DEPARTMENT: To
<br />promote and more definitely insure
<br />the comprehensive and adequate
<br />development of the Port of Red-
<br />wood City through continuity of
<br />control, management and opera-
<br />tion, there is hereby created a de-
<br />partment of the City of Redwood
<br />City to be known as the "Port
<br />Department."
<br />Section 47a. BOARD OF' PORT
<br />COMMISSIONERS: The exclusive
<br />control and management of the
<br />Port Department is hereby vested
<br />'in the Board of Fort Commission.

<br />five (5) members, who shall be ap.
<br />pointed by the City :Manager, sub

<br />No person shall be appointed as
<br />a member of the Board who is
<br />not at the time of his appointment,
<br />and has not been continuously for
<br />'three (3) years immediately pre.
<br />ceding, it qualified elector of the
<br />City of Redwood City.
<br />The members of the Board shall
<br />serve without salary or romperea-
<br />tion.
<br />Section Alb, ORGANIZATION;
<br />TERMS OF OFFICE: Within thir-
<br />ty (30) days after the ratification
<br />of this amendment by the Legis-
<br />'ature, the City Manager shall ap.
<br />point five (5) persons as mem-
<br />bers of the first Board, subject to'
<br />the approval of the Council.
<br />The members so appointed shall
<br />immediately organize by the elec.
<br />Lion of a President, Vice=Presldent.
<br />and Secretary, and make provision
<br />for stated meetings, and shall de-
<br />termine, from time to time, when
<br />and where the Board shall hold
<br />its meetings, which shall be open
<br />to the public.
<br />Said persons shall, thereupon,
<br />also cast lots for their respective
<br />terms:
<br />One (1) of whom shall serve
<br />until the first Monday of July,
<br />1933.
<br />Two (2) of whom shall serve
<br />until the first Monday of July,
<br />1040.
<br />Two (2) of whom shelf serve
<br />until the first Monday of July,
<br />1992.
<br />At the expiration of 'the term
<br />of cacti of said persons so ap.
<br />pointed, their successors shall be
<br />appointed by the City Manager,
<br />subject to the approval of ilia
<br />Council, for a full term of five
<br />(5) years, except in the case of
<br />u vacancy, in which event the
<br />uppdntment shall be for the un,
<br />expired term.
<br />Section 47c. REMOVAL: Any
<br />member of the Board may be re-
<br />moved front nffice on a five -seventh
<br />(5/7) vote of tile whole Council,
<br />or by recall as provided in Sec-
<br />tion 6 of this Charter.
<br />Section 47d. ORDINANCES AND
<br />RESOLUTIONS: All actions taken
<br />by the Board of Port Commission-
<br />ers shall be by motion spread upon
<br />its minutes, or by resolution ex-
<br />cept os hereinafter set forth.
<br />Any member of the Board may
<br />require a record of the vote on
<br />any resolution to be made in its
<br />minutes. The Board shall steep a,
<br />minute book wherein shall be re-,
<br />carded the proceedings taken at list
<br />meetings and it shall keep a rec-{
<br />ord and index of all its resolutions
<br />and ordinances, which shall be
<br />open to public Inspection when not
<br />in use.
<br />No ordinance or resolution shall
<br />be passed or become effective with-
<br />out receiving the affirmative
<br />votes of at le.ast time (3) mpm.
<br />bet's of the Board.
<br />No ordinance shall be placed
<br />upon its final passage until at
<br />least five (5) days have elapsed
<br />after its first reading. All ordl-
<br />nances and resolutions shall be
<br />published at least once in the of-
<br />ficial newspaper of the City or
<br />Redwood City and no ordinance
<br />shall become effective until thirty
<br />(30) days after the date of Its
<br />final passage.
<br />The Board may, by vote of three
<br />(3) of its members, pass emer-
<br />gency measures to take effect at
<br />the time Indicated therein. Emer-
<br />gency measures shall contain a
<br />section In which the emergency Is
<br />,part imilarly set for0i and defined,
<br />and a separate, roll call on the
<br />question of emergency ahall be
<br />taken.
<br />The enacting clause on ordi-
<br />nances passed by the Board shalt
<br />be substantially In these words:
<br />Be it ordained by the Board of
<br />Port Commissioners of the City
<br />of Redwood City as follows:
<br />All ordinances shall be signed
<br />by the President, or Vice -President
<br />of the Board, itnd attested by the
<br />Secretary.
<br />A certified copy of cacti ordi-
<br />nance adopted by the Board shad
<br />be forthwith filed with the City
<br />Clerk, and the City Clerk shall
<br />peep a record and index thereof
<br />which shall at all tlmes be open
<br />to public inspection.
<br />Section Ale. ORDINANCES RE-
<br />QUIRED IN CERTAIN PLACES:
<br />All proceedings for the acquisition
<br />of real property by purchase, con-
<br />demnation, or otherwise, or the
<br />granting of any lease longer than
<br />one (1) year, the fixing, regulating,
<br />and altering schedules of rates,
<br />dockage, wharfage, toils, and
<br />charges for all public -owned docks,
<br />piers, wharves, slips and other fa-
<br />cilities, and for services tendered
<br />by the Port Department, and the
<br />udoption of all general rules and
<br />regulations of the Board, excepting
<br />administrative regulations of it
<br />temporary nature, shall be taken
<br />by ordinance, provided that the
<br />Board may by resolution fix, regu-
<br />late and alter schedules of rates,
<br />dockage, wharfage, toils anti
<br />charges for all public -owned docks,
<br />plers, wharves, slips and other fn
<br />ditties, anti for services rendered 1
<br />by the Port Department for a,
<br />period not to exceed sixty (60)1
<br />days.
<br />Section •17f. POWERS AND
<br />DUTIES OF THE BOARD: Tlie
<br />Board of Port Corn ntlssionersshall
<br />'
<br />have the complete and exclusive
<br />power, and it shall be Its duty
<br />for and on behalf of the City of
<br />Redwood City:
<br />(1) To site and defend in the
<br />name of the City of Redwood City
<br />In all actions and proceedings
<br />wherein there is Involved any mat-
<br />ter within the jurisdiction of the
<br />Board.
<br />. (2) To make provision for the
<br />needs of commerce, shipping and
<br />navigation of the port, to promote,
<br />develop, construct, reconstruct, al-
<br />ter, repair, maintain, equip and op-
<br />erate all waterfront properties i,h-
<br />eluding piers, wharves, sea walls,
<br />docks, basins, channels, slips, land -I
<br />lings, warehouses, flouting and oth-
<br />er plants or works, dredge, and
<br />reclaim land, construct, equip and
<br />operato terminal trackage with sid-
<br />ings and turnouts and railroad
<br />connections between docks, piers
<br />and other port structures, and con-
<br />nect the same with mainline
<br />tracks, and to establish, equip and
<br />operate all other fucillties or aids
<br />Incident to the development, pro-
<br />tection and operation of the port,
<br />as may be deemed proper and de-
<br />sirable In its judgment, and It may
<br />modify Its plans from time to time
<br />as the requirements of commerce,
<br />shipping and navigation may de-
<br />i mand, and as part of such devel-
<br />opment and operation to provide
<br />R for tugs, dredges, fireboats, barges,
<br />cold storage plants, and all other
<br />publicly -owned facilities or appli-
<br />ances, incident to the operation of
<br />the port, of such number and
<br />1 character, and in such places us'
<br />the Board may deem feasible and
<br />proper.
<br />(3) To take charge of, control
<br />and supervise the' Port of Red-
<br />wood City, incitiding all the water-
<br />front properties, and land adjacent
<br />thereto, or under water, structures
<br />thereon, and approaches thereto,
<br />storage facilities and other facil-
<br />ities, and all rights and interests
<br />belonging thereto, which are now
<br />or may hereafter be owned or
<br />possessed by the City of Redwood
<br />City.
<br />(4) To have control and jurls-
<br />diction of the area hereinafter de-
<br />41ned as the "Port Area," and tc
<br />make and enforce therein general
<br />rules and regulations, to the ex-
<br />tent that may be necessary or
<br />requisite for port purposes or har
<br />1 bot• development, and in carrying
<br />lout the powers elsewhere vested In
<br />the Board; provided, however, that
<br />with the approval of the Council,
<br />the Board may relinquish to the
<br />'Council control of. portions of the
<br />said area, and likewise, upon re-
<br />quest of the Board, the Council
<br />may, by ordinance, enlarge the
<br />Port Area.
<br />(5) To require owners of water
<br />terminal properties and facilities
<br />within the port to keep the same
<br />In proper condition and repair and
<br />to maintain -them with especial
<br />reference to the safety of persons
<br />and property and the reduction of
<br />fire hazard or nuisances, and' it
<br />shall have the right to inspect
<br />such terminal facilities at reason -1
<br />able Limen.
<br />(6) To regulate and control alt
<br />Public sprviep and public utlIllips
<br />operated in connection with, or for
<br />the promotion and accommodation
<br />of commerce, navigation or fish-
<br />ery In the Port Area; to fix the
<br />proper license fees to be paid to
<br />the city by any person, firm or
<br />ea•poration operating any such
<br />Public service or utility; and to fix
<br />and regulate the rates or tolls to
<br />be charged or collected for serv-
<br />ices furnished by any such public
<br />service or utility. The Board shall
<br />have the right, at all reasonable
<br />Limes, to have access to, and, in
<br />person, or by its duty authorize(l
<br />representatives, to examine the
<br />books, papers, maps and records
<br />showing the affairs, transactions,
<br />Property and financial condition
<br />of such persons, firms or eorpo.
<br />rations, and to require reports re-
<br />specting said matters from such
<br />Persons. firms or corporations at
<br />such times and In such form an
<br />the Board may prescribe. The
<br />amounts of the license fees to be
<br />paid to the city by any such per-
<br />son, firm or corporation, operat-
<br />ing any suelr public service or
<br />utility, and the rates or tolls to be
<br />charged and collected for service
<br />furnished or suppled byL such pub.
