PIC <br />�I <br />G <br />11 <br />high for the size of the subdivision. They asked that the Council consider <br />their placing $8000 with the City Clerk who could pay the money to the'pav- <br />ing contractor in regular progress payments, or put the money on deposit <br />with the title company who would pay the contractor. They advised that the <br />Bank of America, San Bruno Branch, will verify that they have ample funds <br />to insure the street paving being done and that further the F. H. A. build- <br />ing commitments make it a condition that the improvements be installed and <br />paid for before the mortgages will be insured by the F. H. A. Councilman <br />Fletcher moved, seconded by Councilman McNulty, that Greene Bros. deposit <br />$8000 with the City Treasurer. Under the question,Councilman Britschgi <br />was of the opinion this would be starting a precedent and believed it would <br />be better to place the money in escrow with a title company. After some <br />discussion, Councilman Fletcher changed his motion to read that the $8000 <br />be deposited with the title company, seconded by Councilman McNulty. It <br />h <br />was understood that the City Manager approve all progress payments before <br />the title company pays the payments, Motion passed unanimously. <br />Acting City Engineer Randlett advised that the final map of this subdivision <br />was in order and ready to be accepted. He stated it followed thq tentative <br />map and that the minimum type of improvements.were required. Greene Bros. <br />had presented him with paid county and city tax bills. These receipts were <br />returned to Greene Bros. Councilman Fletcher moved, seconded by Councilman <br />Britso4gi, that the final map of Greene Park be accepted. Motion.passed <br />unanimously. <br />Communication was received from the Land Development Company requesting permis- <br />sion to oross-Chestnut Street and Bay Road with a drill track. This letter <br />had been presented at the last meeting of the Council. Mr. Ludwig Werder <br />appeared at the meeting and explained that this property is adjacent to the <br />National Motor �earing Company and that arrangements have been made to cross <br />the Chamberlain property. City Attorney McCarthy advised that City Manager <br />Blom desired to have this easement granted on a franchise basis rather than <br />by ordinance. He advised that the franchise laws of the State require <br />advertising and taking of bids. He had drawn an ordinance in the event the <br />Council desired to take that action. The ordinance calls for an easement <br />of ten feet rather than twenty feet, as originally drawn, and it was his <br />opinion this would be acceptable to the Southern Pacific Company and would <br />not cost the loss of more of Bay Road than was necessary. City Manager <br />Blom stated that his only objection to the granting of this property other <br />than by franchise was that in event the Southern Pacific was later trans- <br />ferred the right of this property whether they would be willing to accept <br />the maintenance of a strip twenty feet in width. He believed that if less <br />than 20 feet were granted, the city would have some assurance that the area <br />adjacent to the tracks would not be used for a loading zone or something <br />that would interfere with the use by the public of the area adjacent to the <br />tracks. City Attorney McCarthy explained that the ordinance is the same as <br />that passed upon some weeks ago and which had not been accepted by Ross <br />s■ <br />
