Motion passed unanimously. <br />March 41 1946. <br />Honorable Mayor and City Council <br />City of Redwood City <br />Redwood City, California <br />Opinion No. 49. <br />RIGHT OF THE CITY COUNCIL TO APPROPRIATE MONEY TO REPAY THE <br />BOARD OF SUPERVISORS FOR EXPENSES OF ELECTION TO ORGANIZE <br />HOSPITAL DISTRICT IF ORGANIZATION DEFEATED. <br />1 <br />Gentlemen: <br />The local hospital committee has asked my opinion as to the power, or <br />right of the City Council to appropriate approximately $2,100.00 to reim- <br />burse the county of San Mateo for the expenses necessarily incurred in an <br />election to be held for the purpose of organizing a local hospital district <br />in case the election should be adverse to the organization of the district. <br />The expenses estimated are approximately $2,100.00. If the election <br />carries and the district is organized, the Board of Supervisors will meet <br />the expenses by an assessment against the property of the district of the <br />County, but if the district is not organized, the County will want insur- <br />ance that it will be reimbursed for the expenses above mentioned. <br />In the first place we must assume that this election is for the pur- <br />pose of bringing about the organization of a district which will engage <br />in a public activity in distinction from a private activity. A city acting <br />under a charter has all general powers for the management of its local <br />municipal affairs that are not prohibited to it. This provision is par- <br />ticularly stated in Section 3 of the Charter of this City in the introduc- <br />tory paragraph. In subdivision 11 of Section 3 the city is specifically <br />given power to erect and maintain buildings for hospital purposes whether <br />
