1 <br />292 1At Tt is also nossible to let the contract before the bonds are sold. Under <br />the 1911 Aot, it is necessary for the contractor to wait until the work is <br />completed and then have the bonds issued to him. Under this procedure it is <br />necessary for him to finance the work and then sell the bonds. Councilman <br />Armstrong raised the question that if the contract was awarded on the basis <br />of the engineer's estimate and before the work was started bonds were sold, <br />it might be possible that there would be major protests to any additional <br />assessment. Mr. Ingersoll admitted this would create a problem but he be- <br />lieved it could be worked out and that the general practice would be to set <br />the estimate higher than it is expected to let the contract for. City Mana- <br />ger Blom said the city might be liable if the contract were let and it was <br />impossible to sell the bonds. Mr. Ingersoll said if there was any doubt <br />about selling the bonds, the contract is not let until the bonds are sold. <br />Councilman Fletcher offered introduction of ordinance amending Ordinance No. <br />333, seconded by Councilman McNulty. Motion passed unanimously. <br />City Attorney McCarthy advised this was the time set for hearing protests of <br />street assessments under Resolution of Intention No. 1945-4. There were no <br />protests. Councilman Armstrong offered adoption of resolution confirming <br />street assessments under Resolution of Intention No. 1945-4 and moved its <br />adoption, seconded by Councilman Fletcher. On roll call, resolution was <br />unanimously adopted with Councilman inderson absent. <br />RES0LUT ION No. 297 <br />RESOLUTION CONFIRMING STREET ASSESSMENT No. 1945-4. <br />WHEREAS, the assessment for sidewalks and other street work done under' <br />that-adrtain contract dated June 4th, 19459 by and between M. WEBER, first <br />party, and H. L. WINTER, as Superintendent of Streets of the City of Redwood <br />City, second party, for the foing of all sidewalks and other street work men- <br />tioned and described in Resolution of Intention No. 1945-4 passed and adopted <br />by t2is Council of the City of Redwood City on the 16th day of April 1945, and <br />now on file in the office of the Clerk of said City, to which Resolution of <br />Intention reference is hereby made for a description of said work, was filed <br />in the office of the Clerk'of the City of Redwood City on the 2nd day of <br />March, 1946; and <br />WHEREAS, said City Clerk did thereupon fix Monday, the 18th day of March <br />1946, at the hour of 8:00 o'clock P.M. of said day, at the meeting place of <br />the Council of the City of Redwood City in the Council Chamber in the City <br />Hall on Middlefield Road in the City of Redwood City as the time and place <br />for a hearing on said assessment, as required by law, and as the time and <br />place for making written objections thereto, as provided for in Ordinance No. <br />333 of said City of Redwood City; and <br />WHEREAS, Notice of Filing of said assessment and of the time fixed for <br />hearing thereon was duly given by posting, publishing and mailing, as required <br />by law, as appears from the,affidavits of RALPH S. DODGE, LOUISE WHITE, and <br />MAXINE SNYDER, now on file in the office of the Clerk of said City of Redwood <br />City; and <br />WHEREAS, at the time and place last herein mentioned objections of any <br />kind were made against said assessment; and <br />WHEREAS, said Council of the City of Redwood City has now adquired <br />jurisdiction thereon; <br />THEREFORE BE IT RESOLVED by the Council of the City of Redwood Oity, in <br />the County of San Mateo, State of California, that the assessment above men- <br />tioned for sidewalks and other street work done under Resolution of Inten- <br />tion No. 1945-4 hereinbefore referred to herein be, and the same is hereby <br />approved and adopted and the Superintendent of.Streets of said City of Red- <br />wood City is hereby directed to attach a warrant thereto and deliver same to <br />the contractor, as required by law. <br />Passed and adopted by the Council of the City of.Redwood City at a <br />regular meeting thereof held on the 18th day of March, 19469 by the following <br />vote: <br />70 <br />AYES, and in favor of the passage and adoption of the foregoing resolu- <br />�I <br />
