County,Tax.Oollector had -sold the same lots to a,Mr. Thomas Callan.-..The,•County. 45 <br />Tax Collector had been notified that the -lots -had been sold but through an,error <br />this fact was,overlooked. Mr. McCarthy believed the County was responsible for,,, <br />the error inasmuch as proper notification had be.en,given that.the lots were sold. <br />Mr. Schoop explained that the property was registered at the title company in the <br />name of Mr. Callan. Mr. McCarthy explained that there is an agreement with the <br />County whereby the city can sell deliquent tax lots and pro rate the taxes, however, <br />in this case the city did have a deed to the lots in question. <br />The City Attorney was instructed to attempt to settle the matter and to assist' <br />j Mr. Scholp in every way possible. , <br />l <br />City Engineer Wilson reported that he had checked the bide for improvements 'Sn.Redwood <br />Terrace No. 1. There were two small discrepancies in the bids, one in Peter <br />Sorensen's and one in Charles Harney's. The low bid of L. C. Smith in the amount <br />of $146,203.48 was correct. <br />City Clerk,Dodge read communication from Peter Sorensen in which he stated that <br />he was second low bidder on this projegt'in the amount of $149,561.97 with the <br />• completion date as of July 1, 1947. He stated, however, that he would be able to <br />start work immediately on this project and save the owmers sixty,days in comple- <br />tion time, or finish the work May 1, 1947. The owners of the subdivision were <br />in favor of the early completion date and Mr. Sorensen stated he would be glad <br />to receive the award with the understanding that the work would be completed byr <br />3' <br />j' May 1, 1947- ,City Manager Blom advised that upon receipt of Mr. Sorensen's <br />$ letter he had contacted Mr. L. C. Smith who advised that he had alreday placed <br />an order for sewer pipe on the basis that he was low bidder and that he would be <br />able to go to work immediately. He stated he would be able to complete the work <br />j by July 1, 1947- Councilman Werder asked if the Council has.the right to accept <br />the second low bid if the time limit would be better than„1 the low bid. City <br />Attorney McCarthy advised that inasmuch as the bids set a completion date of <br />July 1, 19479 he did not believe the Council was justified in accepting the <br />second low bid and that the low bidder could bring a suit against the work being <br />4, <br />done. If the two contractors could reach an agreement and the low bidder would <br />?' I <br />?f <br />f agree to the second low bidder being awarded the job, Mr. McCarthy believed the <br />;s <br />1 Council could award the bid to the second lowest bidder. City Manager Blom <br />i� <br />ers of the <br />expressed the opinion that no award should be made until the.develo <br />�? P P <br />tract make arrangements for the bonds. City Engineer Wilson drew attention to <br />the Pact that the proposal provided that award would be made within fifteen days <br />i. from the opening of bids. City Attorney McCarthy advised that if L. C. Smith <br />would waive this provision, the matter of award could be held over. It was <br />4 <br />decided that the matter would be carried on the agenda and the two contractors <br />3 contacted. Councilman Granger moved, seconded by Councilman Swift, that the <br />{ matter of awarding contract for improvements in Redwood Terrace No. 1 be carried <br />on the agenda for the next meeting. Motion passed unanimously. <br />Mr. Andrew Norris had appeared at the last meeting of the Council protesting the fact <br />that his house sewer was connected to the lateral of the adjoining property <br />owner. City Manager Blom had had an investigation made of the matter and he <br />advised that these two sewers were connected to the same lateral. He stated <br />
