E <br />366 <br />Royer and Spillers noted absent. <br />RESOLUTION 1128 APPROVING PLANS AND SPECIFICATIONS, CANYON ROAD SEWERS AND STORM DRAINS was offered by Colla. <br />cilman Jones, seconded by Councilman Morgan and carried on roll call. Councilmen Royer and Spillers <br />noted absent. <br />RESOLUTION 1129 FIXING MINIMUM WAGE SCALE CANYON ROAD was offered and moved for adoption by Councilman Granger, <br />seconded by Councilman Herkner and carried on roll call- Councilmen Royer and Spillers noted absenti <br />RESOLUTION 1130 CALLING FOR BIDS, CANYON ROAD, SANITARY AND STORM SEWERS was offered and moved for adoption <br />by Councilman Morgan, seconded by Councilman Jones and carried on roll call. Councilmen Royer and <br />Spillers noted absent. <br />PLANNING COMMISSION REcOM ENDATION TO REZONE LOT 9, BLOCK 2, WELLESLEY PARK (2nd LOT WEST OF GAS STATION) <br />from R-1 to R-3 WAS CONSIDERED. Councilman Jones moved approval of recommendation, seconded by council- <br />man Morgan. City Attorney Currie suggested that proper proceeding would be to introduce ordinance and <br />call a further hearing at the time of adoption. Under discussion it was decided to withdraw mptionand <br />second pending hearing. Mrs. Jessie R. Morser speaking for her husband Ralph C. Morser, 37 Avondale, <br />appeared to protest rezoning. She stated that Master Plan described rezoning as being required to benefit <br />the community as a whole and not a single person. There should also be proof that there is no objection <br />to such rezoning and further more there must be a compelling argument for it. She stated that Dr. Pepper <br />now uses his residence next door illegally as a doctor's office and that this could be used as a home <br />again thus removing part of the argument in favor of the rezoning. She expressed the fear that this <br />spot zoning would extend to other nearby areas. She also pointed out that the Planning Commission voted <br />for this on a mere 3 to 2 vote. Mr. H. A. Nelson also appeared in opposition to the rezoning. He stated <br />that when people were asked to accept the buffer zone it was their understanding that this was to pre. <br />vent further.endroachment on the residential areas. Mr. Dell+Ergo, Attorney, spoke in behalf of his <br />client, Mr. Gruenig. He presented plot plan and photographs of type of apartment contemplated. Plan <br />was for eitht unit apartment section similar to those in the Noel Drive section of Menlo Park and his <br />client+was willing to give assurance that this was the type of dwelling that would be constructed. His <br />interest was in determining what would be the best use for this property. Mr. Gruenig had met with <br />residents in the area and thrashed out the entice matter, and he felt that this type of development <br />would have to come eventually. Mr. Walter Murphy appeared representing North Redwood Neighbors and <br />stated that his organization was also against the rezoning and he felt that the integrity of the Council <br />would insure that they stand behind the Master Plan. After considerable discussion and expression of <br />views by each Councilman, Councilman Herkner moved that recommendation'of Planning Commission be denied <br />and that question of illegal use of residence next door by Dr. Pepper be referred to the City Attorney <br />for investigation, seconded by Councilman Morgan and carried. In explaining his vote Councilman Herkner <br />stated that he was voting in this manner to protect the investment of the people in the area. motion <br />carried, Councilman Jones voting No on roll call. Councilman Jones stated that eventually this entire <br />block would consist of multiple dwelling units and that the price being asked for the lot in question <br />was much too high for residential building. <br />PLANNING C014MISSION RECOINENDATION APPROVED APPLICATION GEO., LEONARD REALTY COMPANY RESUBDIVISION PORTION OF <br />LOT 20, VALOTA ROAD INTO THREE LOTS (corner Valota.Road and Anamor Street), all in excess of 6000 sq- ft - <br />Councilman Herkner moved approval of recommendation, seconded by.Councilman Morgan and carried. <br />RECOMMENDATION OF PLANNING COMMISSION THAT LOTS 9 TO 13, BLOCK 1, REESE SUBDIVISION (corner Poplar and Ebener <br />Street), be resubdivided into three lots 50 x 120 ft, owner John McCarthy. Recommendation accepted on <br />motion of Councilman Morgan, seconded by Councilman Jones and carried. <br />PLANNING COMMISSION REC01WNDED VARIANCE IN SETBACK FOR DR.
