Under Section 2.42 C.2.a. of the Municipal Code, the disposition of the <br /> City Property will secure certain community benefits, including construction and <br /> operation of a childcare facility on the Project site and construction of a publicly- <br /> accessible Creekside trail adjacent to Redwood Creek. <br /> 2. Under Section 2A2 C.2.c. of the Municipal Code, the disposition and <br /> development of the Property serves a common benefit by allowing better and more <br /> compatible uses, including affordable housing, childcare facilities, and publicly- <br /> accessible open space, than its present use and will further the purposes of the <br /> Downtown Precise Plan, through the provision of transit-oriented housing, removing <br /> ongoing maintenance obligations associated with the Property, and community <br /> benefits, also thereby implementing General Plan goals and policies. <br /> Section 3. Disposition and Development Agreement: The City Council hereby <br /> authorizes and directs the City Manager to execute the Disposition and Development <br /> Agreement, subject to any minor, clarifying and conforming changes approved by the City <br /> Attorney.
