We therefore ask your consideration of our request to extend the time of occupant' of the 221 <br />Ross Garage and adjoining property, as outlined in the City Attorney's letter of May 4, <br />1956, from June 15, 1956 to August 15, 1956• <br />"Pete't Towne asked that the dates in this letter be changed to read from July. 15, 1956 to August 6, 1956. <br />Oscar Holmes agreed to the extension provided he will be given an extension of 15 working days on the contract, <br />and that the Council will back him up if the building is not ready to start wrecking on August 6th. City <br />Attorney Currie stated that this should be considered as two dif£ei;ent items. Oscar Holmes stated that <br />August 6th should be the latest date because of the time element concerning the stormy season. Councilman <br />Britschgi moved that Towne Motor Company be given an extension to Ai}gust 6th and Oscar Holmes be -given an <br />extension of 15 working days to coyppensate for the loss of time and the City to back up Mr. Holmes. City <br />Engineer Jain stated that the City will be obligated to pay the additional three weeks time for inspection <br />i� costs. Councilman Weiss made an amendment to the motion that Mr. Towne reimburse the City for any inspection <br />costs due to this delay. Councilman Granger questioned the cost of inspectors during the delay and the cost <br />dul7ing the three week extension: Councilman Stout stated that there is an extra cost and he thought that <br />possible Mr. Towne could pay a porion of the inspectors .fee and therefore Councilman Stout seconded the <br />motion. Councilman Spillers stated that the few property owners have been contacted and they did not object <br />to the delay so he was of the opinion that the City should pay the additional cost. Mr. Towne stated that <br />he would talk with the Council on this matter, however, he did not like the idea of having to pay an add- <br />itional $400. The amendment lost on roll call with Councilmen Britschgi, Granger, Spillers and Mayor Royer <br />voing No and Councilman Herkner being noted absent. <br />The Mayor called for a roll call vote on the original motion. Councilman Granger stated that he thought <br />that there was some other approach that could be made in this situation and he did not vote NO just to favor <br />Mr. Towne. Councilman Weiss spoke in regard to the City having to dray additional funds and he was of the <br />opinion that this should be taken into consideration. This was followed ley discussion. The original motion <br />L. carried on roll call with Councilman Herkner being noted absent. <br />Mr. Towne thanked Mr. Holmes for his consideration in this matter and the Nyaor told Mr. Holmes that the <br />Council was pleased with the progress of his work on the parking lgt. <br />PERSONAL APPEARANCE, R. G. HUNT REGARDING EMERALD LAKE WATER CONNECTION. Mr. Hunt stated that he wanted permis- <br />sion to move the water meter from the present location to his adjoining property. He said he }"as a prospec- <br />tive purchaser for this property. The water meter services 4152 Jefferson Avenue and he wants to transfer <br />this meter to 4160 Jefferson. Councilman Spillers stated that Mr. Hunt had asked for water service because <br />his well went dry. Mr. Hunt stated that the old home can be serviced by the well. Councilman Spillers <br />stated that he well not agree to transfer this water service now and then have Mr. Hunt come back and tell the <br />Council that his well has gone dry and he wants a new,connection. <br />Water Superintendent H. L. W-nter stated that as far as the Water Department is concerned they would not <br />object to transferring this connection, however, the City should protect themselves against possible damage <br />suits if the allow this meter to be moved, leaving Mr. Huntts home to be serviced by well water only. <br />Councilman Britschgi moved that this water meter be transfered from 4152 to 4160 Jefferson Avenue subject <br />to the conditions stated by the Water Superintendent. Councilman Granger stated that he was, of the ppinion <br />that this property will be sold to another property owner. This should be handled by the new owner, Mr. <br />Miller, rather than Mr. Hunt. City Attorney Currie stated thnt it did not make any difference who the <br />property owner was because the meter will be for the property and the home owner. The conditions are <br />(1) that they can not sercie 4152 Jefferson Avenue from the "later meter after it is moved to 1.x160 Jefferson <br />Avenue, and (2) an agreement be made by Idr. Aunt giving the City permission to take the Crater away from him <br />so that the City will not be held responsible. Councilman Britschgi asked to reword his motion so that <br />the Council s ould suggest: that Mr. Miller come before the Council in person asking for a change in relocat- <br />ing the water meter. By doing this then the Council could bind the property owner so that he can not <br />
