Councilman Weiss moved adoption of Ordinance 600.73, seconded <br />by Councilman Spillers and carried on roll call, Councilmen Britschgi, Granger and Stout noted absent. <br />ADOPTION OF ORDINANCE NO. 827, ESTABLISH FIRE ZONE NO. 2, OAK KNOLL AND CANYON ROAD AREA. Mayor Royer stated that Councilman Stout had presented a <br />good report at the recent study meeting, however the council decided that facts and figures presented did <br />not warrant changing the present fee as set up by resolution. Councilman Spillers moved acceptance of <br />q <br />report.9 City Manager to assist Councilman Stout in the event he wished to carry on his studies. Motion <br />seconded by Councilman Weiss and carried. <br />r� <br />PROPOSED REZONING OF DALE STUART PROPERTY FROM R*3 to R-2. Planning Commission failed to carry proposed rezoning, <br />Their deliberations ending in a tie vote of 3 to 3. They then returned the matter to the Council with <br />the recommendation that inasmuch as they failed to reach a decision, the zone be left in R-3 classification. <br />Matter held for public hearing on Tuesday, September 11, 1956. <br />COMMITTEE REPORT ON CONDITION OF SIDEWALKS IN 300 BLOCK CHESTNUT STREET. City Clerk read report of Council <br />i <br />Committee, Councilmen Weiss and Stout: <br />Your committee to explore the problem of sidewalk repairs on the .300 block -of Chestnut Street <br />desires to submit the following report: <br />After consideration of all possible information available, by consultation with the Deputy <br />City Engineez and.interviews with property owners involved, we have come to the following <br />conclusions: <br />a. Though no written records are on file, one of the property owners was able <br />to establish that driveway approaches did exist prior to the resurfacing of <br />this block by the contractor, and it is self evident that they have never <br />been replaced. That the driveways involved in front of 312$21,329 and 322 <br />Chestnut•Stieet are of -approximately 135 square feet of area. <br />b. That the condition of the sidewalks running in front of Lots 7 and 8, 312 <br />Chestnut Street, Jamison property; Lot 9, 332 Chestnut Street, S. J. Miller <br />and Lots 10, 11 and 12, San Mateo County Agriculture Department property are <br />in such condition that repairs must be had. <br />c. That as a result of work by contractor some 25 feet of sidewalk in fron of <br />312 Chestnut (Jamison was damaged as a result of the work of the contractor. <br />d. That the property owners are cognizant of their responsibility, but likewise <br />insist on the city assuming its responsiblity for failure to require contractor <br />to replace driveways and for portion of sidewalk damaged by said contractor. <br />e. That because of time elapsed no recourse against contractor is now possible. <br />Recommendations: <br />a. That the City assume responsibility for the 4 driveways, approximately 135 <br />sq. ft. in area as well as the 25 ft. portion of sidewalk damaged by <br />contractor. ' <br />b. That sidewalks as indicated on attached sketch be repaired in accordance <br />with sidewalk ordinance at property owners expense subject to appropriate <br />credit as indicated in "a" above* <br />c. That the City Engineer be instructed to proceed in accordance with above <br />recommendations under the sidewalk ordinance. <br />Respectfully submitted, <br />Louis Weiss and Hiram S. Stout, Councilmen <br />Mrs. T. Carolla, representing Mrs. Jamieson, appeared stating that after meeting with the committee, certain <br />information had come to hand which she thought should have a bearing on the matter. Estimates have been <br />received from`�'four contractors, and §he was advised that if the sidewalks were built according to city <br />specifications it would result in same being higher than property due to grade of street rising to meet. <br />
