The Clerkread the following letter: <br />Inasmuch as circumstances have not changed materially since our report of August 3, 19563 . <br />this committee feels that all of the statemets contained in that report are still <br />applicable. <br />It should be borne in mind that the existing Use Permit granted by the Planning <br />Commission prohibits dancing and the applicant will have to obtain a new Use Permit <br />to allow dancing in addition to the dance permit to be obtained from the Council. <br />r <br />This was signed by the City Manager, P'I <br />Assistant City Attorney, Chief of <br />Police and Fire Chief. <br />Police Chief Faulstich again referred to the Committee report of August 3rd wherein they objected to <br />the Parking situation. The Committee still objects to outdoor dances and the lack of parking and <br />also to the noise. Mr. J. H. Rowell, attorney for Mr. Huddleton, spoke on the question and asked tht <br />uV <br />Mr. Huddleton be given a limited permit to hold the dances until such time as his building is completed. <br />Councilman Weiss asked what effect this would have if thisvas referred to the Planning Commission for <br />further condideration on his use permit. This was answered by Mr. Lebsack who stated that there were <br />twp permits in question, one is the dance permit and the other was the use permit. The Council can <br />act on the dance permit and the Planning Commission will act on the use permit. <br />Councilman Weiss raised the question that in the event the Council gives approval of the new building <br />would it be leaving Mr. Huddleton with the opinion that the dance permit will be granted and what would <br />happen if the Council should change its mind in the meantime. The Mayor announced that the Committee <br />recommended that the permit be granted after the building is built. <br />Mr. Huddleton stated that the room would be added to <br />the present <br />building and the present platform is <br />moveable. Councilman Britschgi reported on the back <br />his tory of <br />this building. He was of the opinion <br />that the Council would be heading for trouble. He stated that because the Committee made their recom- <br />.4 <br />mendation he was of the opinion that they follow the <br />Committee's <br />recommendation and he so moved. <br />91 <br />Councilman Herkner asked about the interim period of 60 days. Mr. Lebsack read the Committee report <br />of August 3rd. The motion lost for lack of a second. Councilman Herkner moved that when the items <br />mentioned in the Committees report are complied with then Mr. Huddleton be given a dance permit, <br />seconded by Councilman Britschgi. Councilman Granger wanted to know what Mr. Huddleton's action were <br />in regard to the recommendation of the Committee. Mr. Huddleton stated that he would go along with <br />I <br />the recommend ations, however, he stated that the parking would be 40 cars and not 60 or whatever the <br />Committee recommended. Councilman Herkner added to the motion to have sufficient parking for not <br />less than 40 cars and he also included in the motion that Mr. Hudleton state in writing that he will <br />agree to the Committeevs recommendation. Councilman Granger asked that the letter be read as submitted <br />by Mr. Huddleton. The Clerk read the letter. Councilman Granger asked for a roll call vote which <br />carried with Councilman Weiss voting No and Councilmen Spillers and Stout being noted absent. <br />II <br />CONTINUATION OF BID OPENING, HILLTOP DRIVE IMPROVEMENTS. The City Engineer reported that Bauman Brothers--� <br />bid was in order and he recommended that the bid be accepted. The Mayor announced that now was the <br />time to overrule the protests. Councilman Herkner moved that the protests be overruled, seconded by <br />Councilman Britschgi and carried. <br />Councilman Herkner offered RESOLUTION 2090 IMPROVEMENTS ON HILLTOP DRIVE and moved its adoption, <br />.M =p <br />seconddd by Councilman Britschgi and carried `on roll call witliCouncilmen Spillers and -Stout being <br />noted absent. Councilman Britschgi offered RESOLUTION 2091 AWARDING THE CONTRACT TO BAUMAN BROTHERS <br />FOR HILLTOP DRIVE IMPROVEMENTS and moved"its adoption, seconded by Councilman Herkner and carried <br />on roll call with Councilmen Spillers and Stout being noted absent. <br />CONTINUATION ON BID'OPENING, CONSTRUCTION OF RELIEF SANITARY SEWER 1740JECT VIII.
