287 <br />was of the opinion that the understanding should not be followed through and if there is any claim by the <br />Company they should be considered'by negotiations. Councilman Stout moed that the proper authorities <br />negotiate with the Dredging Company and come in with a recomnmridation to the City Council. The City <br />Attorney stated that the only motion made at the last meeting was that the City Attorney prepare the <br />amendment to the contract•and present it to the Council for their consideration to#,ght. The Council is <br />not changing its position but rather the Council reverses any action by the City Attorney and he drop the <br />Wil <br />amendment. Councilman Stout changed his motion to instruct the City Attorney to take no further action in <br />reference to amendment of the constract with the Dredging Comparpy seconded by Councilman Weiss. This was <br />folldwed by discussion after which the motion carried. <br />Councilman Weiss told the Council that he would make a draft of amendment to the Subdivision and Zoning <br />' Ordinance and submit same for a study meeting. He asked the Council to authorize the City Attorney to check <br />14 <br />' his report and make it up in ordinance form so he might present this to the Council so they could set it <br />up for a study meeting. This was followed by discussion. Councilman Weiss moved that they address a letter { <br />to the City Attorney as to whether or not the Council has the authority to, direct, him to draw up the necess— <br />ary papers that the Council asks fora This was again followed by a heated discussion. Councilman Stout did <br />not believe that he wanted the City Attorney to render'an opinion in regard to this matter. He prefers to <br />bring up his own matters and then if the need arises direct the City Attorney to do whatever was needed. <br />This was followed by a very lengthy and argumentative discussion. The motion ltist•for lack of a second. <br />Councilman Britschgi reported that he had attended a Small Boat Harbor meeting in San Mateo. It was an all day <br />session. The purpose of the meeting was to see if the demand was here in the Bay Area for the need of small <br />boat harbors and if they were through how would they be financed•and in what way could the State offer <br />assistant in financing projects and in what way would the State be involved in interstate and manuvering of <br />patterns. Also under discussion was the Pillar Point breakwater. This meeting was only a fact finding <br />tl meeting. <br />Councilman Stout regarding park benches. Councilman Stout read a letter•from the Business and Woments Club <br />asking for the dedication of the benches in time for Business and Women's Club Week. Councilman Stout <br />extended an invitation to the Council to attend the dedication of the benches on•September 211th at noon in <br />front of 2423 Broadway. -This was followed by discussion. I <br />Councilman Herkner spoke about Parking Lot No. 2 which is rapidly being completed and is going -to create a <br />traffic hazard on Pennsylvania•Avehue. He asked that the Traffic Fact'Finding Committee consider making this <br />a one way street. Councilman Herkner so moved, seconded by Councilman Britschgi and carried. <br />Councilman Herkner stated that since the Yacht -Harbor dredging'has been completed they can not allow the <br />investment to lie idle and he felt they should instruct the City Engineer and City Manager to see about <br />development of the Yacht Harbor by the Placing of the berths. Councilman Britschgi stated that the Plans <br />for the berths are just about ready and he will have them before the Council next week. In two weeks they <br />will present a change in the rates for Council consideration. <br />Councilman Weiss again referred to his porposal for changes in the subdivision ordinance and the zoning <br />ordinance. His plan is based on the subdivision of less than 5 lots so that it can be made amicable to <br />provisions of the subdivision ordinance. He moved that the City Attorney be authorized to draw up the <br />ordinance. Councilman Wiss then spoke at some length telling the City Attorney what he wanted'the <br />` ordinance to cover, in other words the City Attorney was to draw up the change inathe- ordinance as he, <br />Councilman Weiss, has stated. This was followed by a somewhat disruptive discussion. Councilman Herkner <br />stated that he did not agree with the changes in this particular matter. He was of the opinion that this <br />should be discussed at a study meeting and they be allowed to bring up the matters that they question in <br />this matter. This was agin followed by discussion after which the motion lost for lack of a second. <br />
