Councilman Granger seconded the motion which carried. <br />Councilman Spillers offered RESOLUTION 2161 APPOINTING RAY WEYMOUTH TO THE OFFICE OF COUNCILMAN and moved <br />its adoption, seconded by Councilman Stout and carried on roll call. <br />Councilman Stout nominated Budd Stevenson as Port Commissioner to fill the vacancy on the Port Commission <br />seconded by Councilman Herkner. Councilman Herkner moved that the nominations be closed,s econded by <br />Councilman Spillers and carried. <br />Gouncilman Spillers offered RESOLUTION 2162 APPOINTING BUDD 0. STEVENSON TO THE BOARD OF PORT COMMISS- <br />IONERS and moved its adoption, seconded by Councilman Granger and carried on roll call. <br />Attorney Lebsack stated that there was a need to adopt a resolution for condemnation of easement in the <br />Highlands of Emerald Lake in order that the work may proceed in installing the sewer and water improve- <br />ments in the district. Councilman Spillers offered RESOLUTION 2163 AUTHORIZING THE CONDEMNATION OF <br />EASEMENTS IN HIGHLANDS OF E21ERALD LAKE TERRITORY NO. 1 and moved its adoption, seconded by Councilman <br />Weiss. This was followed by discussion after which the motion carried on roll call. <br />RESOLUTION AUTHORIZING COMPROMISE PORTION OF CONDEIRIATION ACTIONS, INDUSTRIAL WAY. Mr. Lebsack recommended <br />approval of these resolutions rather than take the matter to court. Co mcilman Spillers offered <br />RESOLUTION 2164 AUTHORIZING COMPROMISE A PORTION OF CONDEMANATION A ACTION, INDUSTRIAL WAY ($100.00)' <br />and moved its adoption, seconded by Councilman Granger and carried on roll call. Councilman Spillers <br />offered RESOLUTION 2165 AUTHORIZING COMPROMISE OF A PORTION OF CONDEMANATION ACTION, INDUSTRIAL WAY <br />($5,250.00) and moved its adoption, seconded by Councilman Weiss and carried on roll call. <br />RESOLUTION ORDERING REFUND,POPLAR-I1ESS-EBENER IMPROVEMENTS. Mr. Lebsack explained to the Council that this <br />resolution was to refund the surplus amounts remaining in the Poplar-Hess-Ebener Area Improvement fund. <br />Councilman Stout offered RESOLUTION 2166 ORDERING REFUND POPLAR-HESS-EBENER IMPROVEMENTS. Mr. Lebsack <br />explained to the Council that this resolution was to refund the surplus amounts remaining in the <br />Poplar-Hess-Ebener Area Improvement fund. Councilman Stout offered RESOLUTION 2166 ORDERING REFUND <br />POPLAR-HESS-EBENER AREA IMPROVEMENTS and moved its adoption, seconded by Councilman Weiss and carried <br />on roll call. <br />CLAIMS FOR !ALLEGED DAMAGES TO PROPERTY DUE TO HILLTOP DRIVE IMPROVEMENTS. The claims were from Ruth Sawyer, <br />102 Hilltop Drive, and John W. and Helen McCune, 354 Eaton Avenue. Councilman Spillers moved that the <br />claims be denied and referred to the insurance carrier, seconded by Councilman Granger and carried. <br />CHIEF FAULSTICH, representing the Junior Chamber of Commerce, presented the Courtesy Driver of the Week <br />rAward to Tom Coats, driver of a commercial truck. <br />John H. Burggraf, Chief in the U. S. Navy, presented a flag to the Council in honor of the young men who <br />volunteered for service. Councilman Granger accepted the gift for the City and stated that he believed <br />the flag would be flown on special occasions only. Councilman Granger then presented the flag to the <br />care of Fire Chief Lodi and asked that the flag be flown at the Veterans Memorial Building. Councilman' <br />Stout moved that s letter be written signed by the Mayor and Councilmen and sent to the proper authorities, <br />seconded by Councilman Weiss and carried. <br />CITY MANAGER REPORT ON "KEEPING THE COUNCIL INFORMED" ARTICLE IN AMERICAN CITY MAGAZINE. Each member of the <br />Council had been furnished with a copy of this report. Councilman Weiss asked that this report be <br />read and in the future that all reports be read or briefed. The Clerk read the report.
