The Mayor announced that there would be a meeting at 4:00 p.m. in the City Manager's office on Wednesday, Juen 26th, with regard to the Yacht Harbor. CITY MANAGER REPORT ON WATER DEPARTMENT -INDEBTEDNESS*. The Mayor asked the Clerk to read the first page of the report which reads as follows: At a regular adjourned meeting held on June 10, 1957, this office was directed by the City Council to reactivate a previous report on the above subject, which was originally submitted on April 4, 1957• ` The Council also requested that a copy of the Court's decision con- cerning an agreement entered between the City and the Land Development Company under date of April 12, 1950, be included in this report. How- ever, since the City Clerk's files contain a copy of this agreement, but do not appear to contain a copy of the Court's action, I am refer- ring this matter to the City Attorney on the assumption that he is better prepared to advise the Council on this legal matter'. While the "propriety" of making refunds is a matter of judgement in which there may be an honest difference of opinion, depending upon the cir- cumstances in each individual case, I am quite sure that all agreements entered into by the City Council for water refunds, were made upon the advice of the City Attorney, after a careful check by the Water Depart- ment as to the amounts involved in each case. However, in an attempt to comply with the Council's directions, I have instructed the 'Water Superintendent to prepare a resume of the City Cle'rk's"files covering a period of several years, concerning trans- actions relating to water refunds in the Redwood Terrace, Westwood Terrace, S erling Highlands and Sterling Heights areae, which are the major locations in question.
