after such notice, by paying applicable charges, fines, and interest. Notice shall be <br /> provided via facsimile if possible. Contractor shall give City a copy of each such <br /> written notice, or a memorandum of such notice given by telephone or e-mail. <br /> Telephonic or e-mail notice shall be in addition to written notice, and may be given at <br /> Contractor's discretion. <br /> <br /> Special Retrieval. Contractor shall provide at no cost to City or Participating Owners <br /> an initial, two-day search of the Service Area and retrieve therefrom all abandoned <br /> Shopping Carts. Contractor shall deliver all such Carts so retrieved in accordance <br /> with the foregoing procedures, except for claiming compensation. The Special <br /> Retrieval herein provided shall not include area outside the City's corporate limits as <br /> shown in Exhibit "A." <br /> <br /> 3. Compensation. (a) Amount. City shall compensate Contractor for the <br />services provided hereunder in an amount calculated at the rate of Three Dollars <br />($3.00) per retrieved Abandoned Shopping Cart except for the Special Retrieval <br />services furnished without cost pursuant to paragraph 2(j). <br /> <br /> Notwithstanding the foregoing, compensation for retrieval of Abandoned <br />Shopping Carts of non-Participating Owners and those which bear no ownership <br />identification shall not exceed the sum of Nine Thousand Dollars ($9,000.00) in a three- <br />(3) month period and shall not exceed Thirty-six Thousand Dollars ($36,000.00 in a <br />twelve- (12) month period. <br /> <br /> (b) Invoices. Contractor shall submit written invoices to City on a monthly or <br />twice-monthly basis, which shall include, or be accompanied by, a detailed statement <br />of services including: (i) the weekly/monthly production summary described in <br />paragraph 2(f); (ii)receipts (in the original or copy) signed by Participating Owners <br />acknowledging receipt of delivery of Abandoned Shopping Carts for the billing period; <br />and (iii) the log (in the original or copy) of Abandoned Shopping Carts delivered to the <br />Center during said billing period owned by Non-Participating Owners or which bear no <br />ownership identification. <br /> <br /> 5 <br />Agmt-321 <br />DES:rg <br />F/shared/shared/Redwood/Council <br />02/07/00; 03/06/00 <br /> <br /> <br />
