<br />ORIGINAL <br /> <br />AMENDMENT NO.3 <br />AGREEMENT FOR AQUATIC PLANT MANAGEMENT AND <br />ENVIRONMENTAL ENGINEERING SERVICES <br /> <br />Waterworks Industries, Inc. <br /> <br />This Amendment No. 3 is entered into and effective as of the 1 ~ day of <br />, 20~ extending the agreement dated February 20, 2004 (the <br />ment") b and between the City of Redwood City, a charter city and municipal <br />cor ration 0 the State of California ("City"), and Waterworks Industries, Inc., a <br />California C poration ("Consultant") (collectively, the "Parties"). <br /> <br /> <br />RECITALS <br /> <br />A. On March 2, 2007, the Parties executed Amendment NO.2 to the Agreement <br />to continue the Scope of Services under Exhibit A of the Original Agreement and the <br />Schedule of Fees under Exhibit B-1 of Amendment No.1, both of which are <br />incorporated herein by this reference; and <br /> <br />B. The Parties desire to extend the Agreement for a period of one year, ending <br />December 31, 2008; and <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br /> <br />1. The Agreement, as may have been amended from time to time, is hereby <br />extended for a period of one year commencing on January 1, 2008 and ending on <br />December 31, 2008 at the not to exceed amount of One Hundred Ninety-Eight <br />Thousand Seven Hundred Eighty-Two and 50/100 Dollars ($198,782.50), <br /> <br />As per City Council Minute Order 04-30 and Provision 3 of the Original <br />Agreement compensation is set at the not to exceed amount of $198,782.50 per each <br />year of the Original Agreement and each amendment thereof. The total compensation <br />is hereby increased to total not to exceed amount of Nine Hundred Ninety-Three <br />Thousand Nine Hundred Twelve and 50/100 Dollars ($993,912.50). <br /> <br />2. All other provisions of the Agreement, as may have been amended from <br />time to time, shall remain in full force and effect. <br /> <br />3. All requisite insurance policies to be maintained by the Consultant <br />pursuant to the Agreement, as may have been amended from time to time, shall include <br />coverage for this Amendment. <br /> <br />Amendment to Extend Time <br />City Attorney Approved Version 090103 <br /> <br />1 <br />
