01/24/2005 <br />2. If the Planning Director determines that the project requires the use of a <br />consultant, special legal counsel and /or a contract planner, the deposit will <br />include either the amount of a proposal from a consultant, special legal <br />counsel and /or contract planner or a reasonable estimate of the cost for <br />the services of a consultant, special legal counsel and /or contract planner <br />during the Project Review Period. <br />3. Estimated City costs associated with legal advertising required for the <br />project. <br />4. A contingency factor of fifteen percent (15 %) of the total of sections C. 1. <br />2. and 3. above. <br />D. Process <br />Conceptual Design Plan <br />When a proponent for a major project first contacts staff, the planner will <br />determine if the proposed project meets the definition of Major Project. If <br />the project is a Major Project as defined by this Policy, the applicant will be <br />required to file a Conceptual Design Plan for the project with the Planning <br />Division. The project proponent shall submit the Initial Deposit. Staff <br />involved in the PRC review shall bill actual time spent on the project at the <br />Billing Rates in existence at the time of the work performed. <br />2. Notice of Application Deposit <br />Based upon the facts presented in the Conceptual Design Plan, the <br />Planning Director or his/her designee shall, within twenty (20) working <br />days of submittal of the Conceptual Design Plan, advise the applicant in <br />writing of the amount of the Application Deposit. If funds remain from the <br />Initial Deposit, these may be retained by the City and subtracted from the <br />Application Deposit, at the discretion of the applicant. <br />3. Appeal of Planning Director's Estimate of Application Deposit <br />a. City Manager <br />If the applicant disagrees with the estimate of the Application Deposit the <br />applicant may, within seven (7) calendar days of being informed of such <br />deposit, appeal the Application Deposit estimate to the City Manager. Any <br />appeal made pursuant to this section shall be consistent with the <br />requirements of Article 48 of the City Zoning Ordinance (No. 1130 as may <br />have been amended from time to time), including the payment of any <br />required appeal fee. <br />b. City Council <br />If the applicant disagrees with the decision of the City Manager the <br />applicant may, within seven (7) calendar days of receipt of the City <br />Manager's determination, appeal the City Manager's decision to the City <br />Council.
