<br />Li.1t <br /> <br />MEMORANDUM FROM THE CITY ATTORNEY/AGENCY GENERAL COUNSEL <br />CONCERNING A CLOSED SESSION BEFORE THE <br />CITY COUNCIL OF THE CITY OF REDWOOD CITY AND <br />THE REDWOOD CITY REDEVELOPMENT AGENCY <br /> <br />TO: <br /> <br />Honorable Mayor, Members of the City Council and <br />Members of the Agency Board <br /> <br />FROM: <br /> <br />Stan T. Yamamoto, City Attorney/Agency General Counsel <br /> <br />SUBJECT: <br /> <br />Closed Session - Existing Litigation [Government Code §54956.9] <br /> <br />Case Names: Wilson & Wilson v. City of Redwood City, et al. <br />[San Mateo County Superior Court Case Nos. 418250, 429131] <br /> <br />A closed session will be held on February 5, 2005, at 1.2:00 noon, for the purpose of conferring <br />with and/or receiving advice from your legal counsel concerning existing litigation which has <br />been formally initiated to which the Council, City and Redevelopment Agency are parties. <br />[Gov't. Code §54956.9(a)] <br /> <br />The City Attorney/Agency General will provide you with a status report on these particular <br />cases. <br /> <br />If the City Council/Agency Board authorizes the City Attorney/General Counsel to defend, or <br />seek or refrain from seeking appellate review or relief, this determination shall be disclosed <br />immediately following this closed session. If the City Council/Agency Board authorizes initiation <br />or intervention, such authorization shall be disclosed immediately following this closed session <br />and the public advised that the action, plaintiffs and other particulars may be disclosed upon <br />request after the action is formally commenced. [Gov't. Code §54957.1(a)(2)]. <br /> <br />If the City Council/Agency Board accepts a settlement offer signed by the opposing party, the <br />substance of the settlement shall be disclosed immediately following this closed session. <br />[Gov't.
