General (continued) <br />This required putting in a 12" fill over the entire dump, digging ditches, and <br />removing some of the refuse and hauling it to another dump. To finance the work, <br />the District sold all equipment and put the proceeds into their general fund, and <br />after several months, Menlo Park approved the work. Further obstacles encountered <br />were requirement of the State that to dissolve a district requires affirmative <br />vote of all seven members, or a special election; that disposition of remaining <br />assets must be determined by the Local Agency Formation Commission and not the <br />District Board; the matter of liability in the event of toxic material at the <br />site; referral of the Board's recommendations to LAFCo; the fact that recent <br />legislation requiring every dump site, open or closed requires monitoring, and if <br />found to be contaminating the environment the property owner is liable; that LAFCo <br />has learned from the Water Quality Control Board that the District at one time <br />operated a dump site in Belmont which closed in 1957; that under the law the <br />assets of the District may not be disbursed until provision is made for monitoring <br />the Belmont site, as well as the Menlo Park site. He believes that ultimately <br />LAFCo will decide that Menlo Park, will be the successor for any remaining assets, <br />and they in turn will pay Belmont, with the remaining members of the District to <br />be held harmless, and that he expects to be at the October meeting of LAFCo, when <br />the matter may be decided. <br />Mayor Claire thanked Mr. Rhodes on behalf of the Council for his excellent report. <br />---------------------------------------------------------------------------- - - - - -- <br />ORAL COMMUNICATIONS <br />(see page 9 ) <br />MATTERS OF COUNCIL INTEREST <br />1. Councilman Greenalch, Council representative to the Regional Planning <br />Committee of San Mateo County, distributed to Council copies of a letter from <br />Jack Morris, Committee President, to the Board of Supervisors, to which were <br />attached three resolutions relating to concerns of the RPC regarding <br />transportation and transit. He asked that Council review the information and <br />at some later time, if Council agrees with the concerns of the Committee, <br />that it express support for the proposals to ask the County to take a leader- <br />ship role in formation of a Joint Powers Agency to establish a permanent mass <br />transit system in the San Francisco -San Jose urban corridor; urging the <br />County to sponsor an inventory of potential rights of way and to develop <br />programs for rights of way preservation. He advised that he has been <br />requested to bring back to the Committee's next meeting later this week any <br />information regarding action taken by this or previous Councils to protect <br />possible rights of way in the City relating to transportation issues, and <br />would obtain this information from the Community Development Department. <br />Councilman Stangel offered to discuss the matter with SamTrans and work with <br />Councilman Greenalch with regard to bringing a report back to Council. <br />Reg.Mtg. <br />9/22/86 MINUTE BOOK NO. 46 <br />Page 5 Page No. 403 <br />
