6. RESOLUTION NO. APPROVING AN AMENDMENT PROPOSED BY OWNERS OF LOTS 1, 2, 3 AND <br />4 OF CORDILLERAS HEIGHTS, UNIT NO. 4 TO "19 FT. PRIVATE INGRESS /EGRESS <br />EASEMENT MAINTENANCE AGREEMENT "; AND APPROVING NAUTILUS INSURANCE COMPANY <br />POLICY NO. L13915 AS ENDORSED AS A CITY GRANTED LIABILITY INSURANCE COVERAGE <br />EXCEPTION ALLOWED UNDER THE LOT OWNERS' PROPOSED AMENDMENT TO THE SAID <br />MAINTENANCE AGREEMENT <br />Discussion took place and City Manager Smith, City Attorney Schricker and <br />Director of Public Works Addiego replied to questions concerning details <br />relating to the insurance coverage referred to in the subject resolution and <br />whether the policy does what is required by the City <br />M /S: Stangel/ to adopt the subject resolution <br />The motion failed for lack of a second. <br />M /S: Greenalch/ that the matter be referred through the City Manager <br />to the City Attorney for analysis as to the substantive meeting of the <br />requirements; that there be sufficient liability insurance on this piece of <br />roadway; that it be adequately maintained; and that the City does not incur <br />any liability by agreeing to this reduction from $1,500,000. <br />Mr. Schricker said that it is not appropriate for his office to advise <br />regarding the amount of liability insurance coverage. <br />MOTION WITHDRAWN: Councilman Greenalch withdrew his motion. <br />Mr. Smith's offer to provide a report on the subject item was accepted by <br />Council. In response to inquiry by Councilman Britschgi regarding the status of the <br />prospective Edward Nagel development at Main and Broadway, Community <br />Development Director Schroeter confirmed that Mr. Nagel has not yet paid for <br />certain appraisals, and said that an application for a permit has been filed <br />but not yet acted upon. <br />ADJOURNMENT <br />M /S: Stangel / Greenalch to adjourn. <br />Carried unanimously by voice vote and City Council adjourned at 9:05 p.m. <br />JACQUELINE C.
