<br />e. Notwithstanding any provision to the contrary in <br />this Agreement, the Developer agrees to accept and comply fully <br />with any and all reasonable conditions of approval applicable to <br />all permits and other governmental actions affecting the Project. <br /> <br />f. The Developer shall cause landscaping plans for the <br />Project to be prepared by a licensed landscape architect acceptable <br />to the Developer and the Agency. The Developer shall prepare and <br />submit to the Agency for its approval, preliminary and final <br />landscaping plans for the Property. These plans shall be prepared, <br />submitted and approved within the times respectively established <br />therefor in the Schedule of Performance and shall be consistent <br />with the Scope of Development. The Developer shall prepare and <br />submit development plans, construction drawings and related <br />documents for the development of the Project consistent with the <br />Scope of Development to the City and the Agency for review <br />(including, but not limited to, architectural review of the <br />exterior of structures); provided, however, that the Agency shall <br />not have the right to approve development plans, construction <br />drawings or related documents for purposes of the issuance of a <br />building permit or otherwise on behalf of the City. Additionally, <br />for purposes of this Agreement, the parties acknowledge that the <br />Agency's approval of said plans, drawings and development documents <br />shall be assumed upon City's"approval of said plans, drawings and <br />documents. The development plans, construction drawings and <br />related documents shall be submitted in two stages -- preliminary <br />and final drawings (Le., working drawings), plans and <br />specifications. Final drawings, plans and specifications are <br />hereby defined as those which contain sufficient detail necessary <br />to obtain a building permit from the City. Any such items <br />submitted to and approved in writing by the Agency shall not be <br />subj ect to subsequent disapproval by the Agency, and any such <br />Agency approval shall not be unreasonably withheld. <br /> <br />g. During the preparation of all drawings and plans for <br />the Project, the Agency Staff and the Developer shall hold regular <br />progress meetings to coordinate the preparation by the Developer, <br />and the submission to and review by the City and the Agency of <br />construction plans and related documents. The Agency Staff and the <br />Developer shall communicate and consult informally as frequently as <br />is necessary to ensure that any such plans and related documents <br />submitted by the Developer to the City and the Agency can receive <br />prompt and speedy consideration. <br /> <br />h. The Agency has approved the building exterior and <br />design of the Project.
