Except for that portion <br /> improved to City standards, Laurel Way is a private road (including that <br /> portion paved to a one-half width of a standard street). <br /> b. Laurel Way is located on uneven, steep terrain. The average slopes of <br /> undeveloped lots fronting on Laurel Way range from 21 percent to 64 <br /> percent. <br /> c. A plat of Laurel Way, showing improved and unimproved lots fronting <br /> thereon, is attached hereto, marked Exhibit "A," and by this reference <br /> incorporated herein. References herein to street numbers correspond to <br /> the lots so numbered on Exhibit A. <br /> d. In 1971, assessment district proceedings were instituted for the <br /> improvement of Laurel Way. Those proceeding were terminated upon <br /> opposition by some of the landowners to be assessed. Pursuant to those <br /> proceedings, plans for the construction of street and associated utility <br /> improvements were prepared entitled, "Laurel Way Improvement Unit No. <br /> 2," dated 9/13/71 (the "Improvement Plans"), which Plans are on file in the <br /> office of the City Engineer. <br /> e. In 1982, upon application of the owner, variances to certain provisions of <br /> Ordinance No. 1130, as amended (the "Zon.
