�,��_�.-. <br /> REVOCABLE ENCROACHMENT PERMIT AGREEMENT <br /> (San Carlos Stairs) <br /> This Revocable Encroachment Permit Agreement ("Permit"), dated <br /> , 2005, is made by and befinreen the City of Redwood City ("City"), and <br /> San Carlos Stairs ("Permittee") (collectively, the "Parties"). <br /> RECITALS <br /> A. Permittee has requested permission to develop a vacant lot at 1204 <br /> Shasta Street with a new 5,100 square foot warehouse style building on a 9,690 square <br /> foot site, as further described in Exhibit "A," which is attached hereto and incorporated <br /> herein by reference (the "Project"). <br /> B. The proposed project includes a second-story eave that projects over the <br /> public right-of-way ("Right-of-Way") that is owned and controlled by the City. <br /> C. It is the intention and desire of this Council to grant a revocable <br /> encroachment permit permitting the encroachment of the second story eave over the <br /> Right-of-Way, subject to certain designated terms and conditions. <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> 1. Scope of Permit. City hereby grants a revocable encroachment permit to <br /> Permittee to allow the encroachment of the second-story eave over the Right-of-Way. <br /> This permit shall commence on date first written above, on a month-to-month basis, <br /> terminable pursuant to Section 2 hereunder. <br /> 2. Temporarv Permit. This Permit is temporary in nature, and does not <br /> constitute a deed, grant, of easement or lease, or other conveyance of any right, title, or <br /> interest in or to the Right-of-Way. The City or Permittee, respectively, as terminating <br /> � party may terminate this Permit at any time during which it is in effect by giving notice <br /> thereof to the non-terminating party not less than thirty (30) days prior to the effective <br /> date of termination. <br /> 3. Condition of Right-of-Way and Maintenance. Nofinrithstanding Exhibit "A" <br /> of this Agreement, Permittee agrees to maintain the Right-of-Way in a neat and <br /> attractive condition. <br /> 4. Citv Access. City reserves the right to unlimited access to the Right-of- <br /> Way or any part thereof for municipal purposes including, but not limited to, the <br /> performance of maintenance and repairs of any and all structures or public <br /> improvements, if any, heretofore or hereafter installed and/or constructed in or upon the <br /> Right-of-Way, the inspection of the Right-of-Way, the use, maintenance, repair of <br /> adjoining areas or for any other purpose in furtherance of City's use of the Right-of- <br /> Way. Notwithstanding the foregoing, City shall extend reasonable efforts not to <br /> Atty/Permits/2005.013 � <br /> 021705 <br />
