MOTION: to approve findings re dance permit (203 -10) Findings of City Attorney re appeal 7/19/85 Because the attorney for Shooter Mc Gee's had requested the opportunity to discuss the matter of the action taken by the City Council last week, to uphold the denial by the Chief of Police of a dance permit, Mayor Britschgi requested comment by Senior Assistant City Attorney Case. Ms. Case advised she has reviewed the letter of July 22, 1985 from Bruce B. Roberts, attorney for Shooter Mc Gee's which lists allegedly new or changed conditions; that the proceeding undertaken by Council on July 15, 1985, was a quasi - judicial proceeding; the decision made was based on the record at the time, and the general legal procedure in this case is to not grant a reconsideration unless there is new evidence presented; that the items in the letter do not constitute new evidence, and her recommendation is that Council should not reconsider at this point.
