Carried unanimously by voice vote and public hearing closed at 8:35p.m. M /S: Bury /Rhodes to reverse the decision of the Zoning Administrator and grant the appeal for the Use Permit for a parking lot on property located at 840 Vera Avenue, Church of Christ, 901 Madison with the conditions that fence height not be more than 6'4 "; that there be a 15' setback and that the gate be locked, the following findings having been made : The establishment, maintenance and operation of the use applied for will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of the proposed use and will not be detrimental or injurious to property or improvements in the neighborhood or to the general welfare of the City for the following reasons: i. The proposed use will preserve the purpose of Article 30 of the Zoning Ordinance in that it will provide for off - street parking of vehicles reasonably close to the property to be served thereby, thus reducing the demand for on- street parking; ii. Alternatives to the design of the off - street parking facility as proposed by the applicant would create unsafe conditions with respect to the use of the applicant's premises located nearby for pre - school and other programs for children; iii. The proposal will enhance the value of properties in the neighborhood by creating an improved condition of an otherwise unimproved lot. Carried unanimously by roll call vote.
