Item No. 6 (continued) <br />Vice Mayor Mosher invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Rhodes /Stangel to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 10 :12 p.m. <br />There being no objection, Vice Mayor Mosher ordered that Appeal b. will be <br />considered first. <br />M /S: Rhodes /Claire to deny appeal b. of Vladimir Starov et al., the <br />following findings having been made: <br />i. The findings of the Zoning Administrator in his Report dated August <br />8, 1985, are adopted and incorporated herein by reference. <br />ii. Additionally, the establishment, maintenance and operation of the <br />use applied for will not, under the circumstances of the particular <br />case, be detrimental to the health, safety, peace, morals, comfort, <br />and general welfare of persons residing in the neighborhood of the <br />proposed use and will not be detrimental or injurious to property or <br />improvements in the neighborhood or the general welfare of the City <br />in that: <br />a. The conditions attached to the Use Permit (as modified <br />hereinafter by the City Council) adequately address the concerns <br />of the appellants regarding traffic conditions, non - residential <br />aspects of the use, and such other objections raised by the <br />appellants. <br />iii. There exists a substantial community need for the facilities <br />proposed to be operated under the Use Permit. <br />Carried unanimously by roll call vote. MINUTE ORDER NO. 85 -116 <br />M /S: Rhodes /Stangel to grant revision of the Use permit for a church and <br />private school, to include a day care center at Redeemer Lutheran Church/ <br />School, 452 Grand Street, the following findings having been made: <br />i. The establishment, maintenance and operation of the use applied for <br />will not, under the circumstances of the particular case, be <br />detrimental to the health, safety, peace, morals, comfort, and <br />general welfare of persons residing or working in the neighborhood <br />of the proposed use and will not be detrimental or injurious to <br />property or improvements in the neighborhood or the general welfare <br />of the City based on the findings of the Zoning Administrator set <br />forth in his Report dated August 8, 1985, which findings are <br />incorporated herein by reference. <br />Reg.Mtg. <br />8/12/85 <br />Page 6 <br />MINUTE BOOK NO. 46 <br />Page No. 18 <br />
