The above language is the portion of the Deed that the owners would like to have <br /> removed. <br /> <br />Resolution for Revocable Permit. In 1986, when the current office building was built, <br />Resolution No. 10309 was approved, which granted a "revocable" permit for access to <br />the property over a storm drain channel. The language that is of concern to the Owner <br />states the following: <br /> <br /> "This permit is temporary in nature, does not constitute a deed or <br /> grant of easement, and may be revoked without cause at any time at <br /> the will of the Council of the City of Redwood City... <br /> <br /> Issues <br />The property is in the process of being sold, and the property owners have requested <br />these changes to clear up the title, and make sure they have continued access to their <br />property. <br /> <br />Quit Claim Deed. The reversionary clause in the Quit Claim Deed is a bit unusual, and <br />is not particularly relevant today. With all of the land use, zoning, building, and <br />business license restrictions, it would be hard to build a building or change the use of <br />the existing building without the City's approval. The existing narrowly defined use of <br />the property in the Quit Claim Deed, and the current Zoning Ordinance requirements <br />would only allow Public or Quasi-public uses (IR-Industrial Restricted District) as <br />permitted uses. The existing office would be allowed to remain as long as the building <br />remains occupied, and is not vacated for a period longer than six months. <br /> <br />The use of this site for office may not be the "best" use of the site from a long term <br />perspective, but the restrictions in the Quit Claim Deed and the Zoning Ordinance will <br />insure that any change in land use will have to be approved by the City Council, unless <br />the future use is Public or Quasi-public. <br /> <br />Easement A.qreement. The current "Revocable Permit" allows the property to have a <br />bridge across the storm drainage channel. This Permit allows the City to revoke the <br />permit at any time, and requires the bridge to be removed, leaving the property with no <br />access. <br /> <br />Obviously, the removal of the bridge and loss of access would be a significant problem <br />for the property owner. The 'Easement Agreement" will allow access across the storm <br />drain channel, but also protects the City if we ever need to work on the channel or <br />relocate the bridge. The property owner will be 100% responsible for any costs. <br /> <br />Resolution for Revocable Permit. Because there is a Revocable Permit issued by <br />Resolution of the City Council, that Resolution should also be rescinded as part of the <br />approval of the Easement Agreement (Resolution No. 10309). <br /> <br /> -2- <br /> <br /> <br />
