REPORT <br /> To the Honorable Mayor and City Council <br /> From the Cit7 Mana ler <br />June 3, 2002 <br /> <br />Subject <br />GID 1-64 Development Agreement Temporary Extension <br /> <br />Recommendation <br />Introduce an Ordinance approving and authorizing the fourth amendment to the <br />Development Agreement with Redwood Shores Properties, for temporary extension <br />period of sixty (60) days, up to and including August 23, 2002. <br /> <br />Background <br />On May 20t~, 2002, after a public hearing, the City Council approved the concept to <br />pursue an extension of GID 1-64 Development Agreement with Redwood Shores <br />Properties. City Council directed staff to begin the process and negotiations with <br />Redwood Shores Properties for a three year extension without the sunset clause. <br />Under the new extended Development Agreement, the City intends to designate one of <br />its three representatives of the Management Committee to the Redwood Shores <br />Homeowners Association. The City would also like to have the support of Redwood <br />Shores Properties to designate two of its three representatives to the Redwood Shores <br />Owners Association, and the Shores Business Center Association. <br /> <br />On May 24, 2002, City Staff and the GID 1-64 Committee Chairperson, Mr. Don <br />Warren, visited the Redwood Shores Properties representative, Mr. Kendall Patton, <br />Attorney at Law. Mr. Patton has conceptually acknowledged the need to extend the <br />Development Agreement with a modification that relieves Redwood Shores Properties <br />of any financial obligation. A detailed Amendment is under preparation with the owner <br />of Redwood Shores Properties. In order to allow time for the preparation of all <br />documents necessary to extend the Development Agreement for another three years, <br />as directed by City Council on May 20, 2002, the City and Redwood Shores Properties <br />have agreed to temporarily extend the existing Development Agreement for sixty (60) <br />days. <br /> <br />As part of this Development Agreement Temporary Extension, Redwood Shores <br />Properties is granting, and the City is accepting, fee title of property known as "Davit <br />Lane Parcel" (see attached map) to the City of Redwood City. This is a landscaped <br />strip of land between Davit Lane and the interior lagoon that is privately owned and <br />maintained. The acceptance of this parcel by the City will require City maintenance, but <br />the City will also have control over use as well as maintenance of the property. <br /> <br />Alternative <br />Not approve the Amendment to the Development Agreement, and/or modify it as <br />necessary. <br /> <br /> <br />
