Item No. 1 (continued) <br />Mayor Britschgi noted that the public hearing has been continued open and <br />read the following: <br />"This is the time and place set for hearing on the Seaport Boulevard <br />Assessment District. Notices have been posted, published and mailed pursuant <br />to law. These proceedings were undertaken pursuant to a petition filed with <br />the City and executed by the owners of more than 60 percent in area of the <br />property subject to assessment petitioning this Council to undertake <br />proceedings pursuant to appropriate special assessment and assessment bond <br />acts. This hearing is a hearing on the Engineer's Report prepared pursuant <br />to the provisions of the Municipal Improvement Act of 1913. <br />"The Engineer's Report prepared by the Engineer consists of plans and <br />specifications of the proposed improvements, maps and descriptions of the <br />lands and easements to be acquired, the Engineer's statement of the itemized <br />and total estimated cost and expenses of the acquisitions and improvements, <br />including the incidental expenses in connection therewith, a diagram showing <br />the assessment district and the boundaries and dimensions of the respective <br />subdivisions of land within the district and an assessment in accordance with <br />benefits. Any one of these items may be the subject of protest or <br />endorsement. <br />All written protests to be computed in the protest percentage in relation to <br />the Engineer's Report should have been filed with the City Clerk on or before <br />7:30 o'clock p.m. Protests or endorsements may be made by any person <br />interested, but only written protests filed by the owners of the property <br />may be considered in determining the percentage of protests. <br />"You are asked to clearly identify yourself and the property owned by you so <br />that your statements may be correctly recorded. <br />"The hearing is declared open and I will ask the City Clerk to report on the <br />various notices given in connection with the hearing." <br />City Clerk Hildebrand read the following: <br />"Notices have been posted, published and mailed as required by the Municipal <br />Improvement Act of 1913. Affidavits and certificates of posting, publishing <br />and mailing are on file in my office. A copy of the Engineer's Report <br />prepared by the Engineer was filed in my office on February 4, 1985, and has <br />been open to public inspection since that time." <br />City Manager Smith described the project stating that the only part of the <br />assessment district before Council this evening is the part related to <br />reconstruction and widening of Seaport Boulevard for which there is one <br />assessee.
