Whereas, pursuant to Section 15074 of the Guidelines to the California <br />Environmental Quality Act of 1970, as amended ("CEQA Guidelines"), the Negative <br />Declaration completed by Agency staff and dated March 28, 2001 serve as environmental <br />documentation for the Fifth Amendment; and <br /> <br /> Whereas, on May 1, 2001 the Planning Commission adopted and approved the <br />Negative Declaration in compliance with Section 15074 of the CEQA Guidelines; and <br /> <br /> Whereas, on June 11, 2001, the Council and the Agency conducted a joint public <br />hearing which was duly noticed in accordance with the requirements of the <br />Redevelopment Law. <br /> <br /> Whereas, on June 25, 2001, the Council, by Resolution No.01-66, adopted <br />"Written Findings in Response to Written Objections" and overruled all objections <br />received to adoption of the Fifth Amendment. <br /> <br /> NOW, THEREFORE, the Council of Redwood City does ordain as follows: <br /> <br /> SECTION 1 In accordance with California Health and Safety Code Sections <br />33367 and 33457.1, and based upon the evidence contained in the Report to City Council <br />and on the evidence presented at the joint public hearing, the Council finds and <br />determines with respect to the Fifth Amendment that: <br /> <br /> a) The Project Area is a blighted area, the redevelopment of which is <br />necessary to effectuate the public purposes of the Redevelopment Law (see particularly <br />Part II of the Report to City Council regarding evidence for this finding). <br /> <br /> b) The Fifth Amendment would redevelop the Project Area in <br />conformity with the Redevelopment Law and would be in the interest of the public peace, <br />health, safety, and welfare; and the implementation of the Fifth Amendment would <br />promote the public peace, health, safety and welfare of the City of Redwood City, and <br />would effectuate the purposes and policy of the Redevelopment Law (see particularly <br />Parts I, II, and III of the Report to City Council regarding evidence with respect to this <br />finding). <br /> <br /> c) The adoption and implementation of the Fifth Amendment are <br />economically sound and feasible (see particularly Part IV of the Report to City Council <br />regarding evidence with respect to this finding). <br /> <br /> d) The Fifth Amendment is consistent with the General Plan of the <br />City, including but not limited to the Housing Element of the General Plan (see <br />particularly Part VII of the Report to City Council regarding evidence with respect to this <br />finding). <br /> <br /> e) The condemnation of real property, if any, is necessary to the <br />execution of the Redevelopment Plan and adequate provisions have been made for <br /> <br /> -2- <br />AK/DES: 6/19/01 <br /> <br /> 2211 <br /> <br /> <br />
