Item No. 1 (continued) <br />Fire Prevention Officer Ornelas supported statements made by the Building <br />Official, commented concerning his own investigation accompanied by a <br />representative of the Health Department and also noted the Fire Department <br />has observed safety problems with the building. <br />Mayor Stangel declared the public hearing open at 7:50 p.m. <br />Bob Radcliffe, Alisal Land Co., owner of the building, said his company <br />has owned the building since August 1983, and plans to construct a project <br />there, stating as soon as he has approval to construct it, the subject <br />building will be demolished. Mr. Radcliffe mentioned his estimated cost <br />of eliminating the structure and reported that attempts have been made to <br />make the building secure from entry. <br />Discussion followed and Mr. Radcliffe and City Attorney Schricker replied <br />to questions and commented concerning the lack of relationship between any <br />future plans of the property owner for the site and the existence of a <br />building there which is now a public nuisance; the refusal of the Fire <br />Department to use the building as a project because of safety hazards; the <br />length of time the owner would require to demolish the building; the <br />desire of the owner to attempt to abate the nuisance presented by the <br />building rather than demolish it now; the fact that the City can demolish <br />the building and place a lien on the property for the cost of the <br />demolition; the failure of the owner to abate the nuisance since it was <br />called to his attention by notice dated March 6, 1984; and the desire of <br />Council to have the hazards eliminated immediately. <br />Mayor Stangel invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Biagi /Rhodes to close the public hearing. <br />Carried unanimously and public hearing closed at 8:10 p.m. <br />Building Official Malkemus stated for the record that today he received <br />five sheets of concept drawings from the owner of the subject building for <br />consideration by the Plan Review Committee, stating that the drawings are <br />not detailed plans. In response to question, Mr. Malkemus said that a <br />life and health hazard exists now calling for immediate demolition of the <br />building or securing it to prevent entry with the premises cleaned up. He <br />noted that the fence is not the type permitted and that the marquee is <br />dangerous. <br />In response to question, Fire Prevention Officer Ornelas said that serious <br />health and other hazards make the building undesirable for a fire training <br />project. <br />M /S: Biagi /Rhodes to continue the public hearing on the Abatement of <br />Public Nuisance at 851 Brewster Avenue, belonging to Alisal Land Co. for <br />30 days and that the building is to be boarded up, the exterior cleaned up <br />and generally it is to be made fully secure to the satisfaction of the <br />Building Department and the Fire Department by Friday, March 30, 1984, and <br />that at the conclusion of the 30 -day period the City Council will take <br />whatever action might be indicated. <br />Reg.
