B- i <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> March 28, 2005 <br /> Subject <br /> Approval of Waiver of Claims and Indemnification Agreement with the Metropolitan <br /> Transportation Commission <br /> Recommendation <br /> Approve and authorize execution of Waiver of Claims and Indemnification Agreement <br /> with the Metropolitan Transportation Commission, for City participation in the Traffic <br /> Engineering Technical Assistance Program. <br /> Background <br /> The Metropolitan Transportation Commission (MTC) has selected Redwood City to <br /> receive a grant for assistance under their Traffic Engineering Technical Assistance <br /> Program (TETAP). The City will receive assistance from one of several consulting firms <br /> contracted by MTC under this program. MTC will fund the consultant assistance for two <br /> TETAP projects in Redwood City this year: <br /> 1. Redwood Shores Parkway Signal Coordination: Revise the timing of the four <br /> traffic signals on Redwood Shores Parkway to provide improved signal <br /> coordination between intersections and reduce travel time and delay. <br /> 2. Woodside Road/Kentucky Avenue Traffic Operations and Safety: Evaluate <br /> safety and traffic operations at the existing pedestrian crosswalk on Woodside <br /> Road at its intersection with Kentucky Avenue, and develop and evaluate <br /> potential traffic and pedestrian safety improvements. <br /> To receive the TETAP grant, the City is required to enter into an agreement with MTC <br /> to: (1) waive any and all claims against MTC for any loss liability or damages resulting <br /> from the agency's participation in the program; and (2) indemnify, hold harmless, and <br /> defend MTC against any and all third party claims that may result from the Agency's <br /> participation in the program. City must submit the signed Agreement to MTC no later <br /> than Friday, April 1, 2005, to participate in the project. <br /> Alternative <br /> If City chooses not to enter the indemnification agreement with MTC, then the City will <br /> not receive the TETAP grant assistance. Staff is not likely to have time to perform the <br /> two candidate projects in-house during the next year. <br /> Fiscal Impacts <br /> Negligible.
