Peninsula New Life Center Report <br /> <br />Report of City Manager and Senior Citizens <br />Advisory Committee 6/23/82 (also see <br />previous reports) <br /> <br />Stuart Auchincloss, attorney, Fitzpatrick Building, replied to questions <br />relating to financial details of the subject Center and to the contract <br />arrangements with prospective residents of the Center for housing, meals <br />and service. <br /> <br />Rev. Rick Howard, Peninsula Christian Church, commented and replied to <br />questions concerning the need for the proposed Center; the conditions <br />regarding the 50 units which the Church would sell; State licensing <br />requirements; the extent of care available at the Center to residents; <br />the circumstances which would lead to a resident being required to move <br />elsewhere; and the Center's obligation and responsibilities to residents <br />at such time as they might not be able to pay the monthly operating charge. <br /> <br />Discussion followed and Mr. Auchincloss commented and replied to ques- <br />tions relating to the existence of a municipal benefit of the Center; the <br />facilities, service and meals to be provided; the likelihood of residents <br />being able to continue to meet monthly costs; and whether applicants for <br />residence will be screened financially. <br /> <br />John Irons, Ziegler Securities, Walnut Creek, described the documents <br />to be drafted by the bond counsel for bond buyers. <br /> <br />City Attorney Schricker stated that the substance of a municipal purpose <br />for the Center and the findings of a bond counsel are different. Mr. <br />Schricker pointed out that features of the Center would have to distin- <br />quish it as a public versus private benefit. <br /> <br />M/S: Claire/Biagi to continue consideration of the Peninsula New Life <br />Center until July 19, 1982 and in the interval, a committee composed of <br />Councilmen Claire and Biagi and representatives of the applicants <br />(Peninsula New Life Center) get together to take a look at the proposed <br />Center as the subject of providing municipal benefits. <br /> <br />The motion failed on a voice vote which t1ayor Stangel determined to be <br />3-3. <br /> <br />M/S: <br /> <br />Mosher/Britschgi to vote now with regard to the subject Center. <br /> <br />Rev. Howard (see above) suggested he believes there are ways in which the <br />Center meets the requirement of being a municipal benefit and therefore <br />eligible for tax exempt revenue bonds to be issued by the City. He <br />urged further consideration of the matter. <br /> <br />MOTION WITHDRAWN: <br /> <br />Councilman Mosher withdrew her motion. <br /> <br />M/S: Claire/Biagi to reconsider the motion which failed by a tie voice <br />vote.
