<br />may be amended from time to time) which are necessitated by, and compatible with, the SBSA <br /> <br />Facilities, the Federal Water Pollution Control Act, as amended by the Federal Water Pollution <br /> <br />Act Amendments of 1972 (Public law 92-500,33 D.S.S. §151, et seq.), and related Federal/State <br /> <br />regulations. <br /> <br />NOW, THEREFORE, in consideration of the above recitals and of the mutual promises <br /> <br />herein contained, the Parties agree as follows: <br /> <br />1. DEFINITIONS. The following words or phrases whenever used in this Agreement <br /> <br />shall have the following meanings hereinafter respectively ascribed thereto: <br /> <br />a. SBSA. The South Bayside System Authority, a public entity established by joint <br /> <br />exercise of powers agreement made pursuant to Articles I and II (commencing with <br /> <br />6500) of Chapter 5, Division 7, Title I, of the California Government Code, and <br /> <br />entered into by and between the Cities of Belmont, Redwood City, and San Carlos, <br /> <br />municipal corporations of the State of California, and the West Bay Sanitary District, <br /> <br />a sanitary district formed pursuant to the Sanitary District Act 1923 (Div. 6 <br /> <br />commencing with 6400, Calif. Health and Safety c.). <br /> <br />b. SBSA Facilities. <br /> <br />The transmission lines and sanitary treatment plant and <br /> <br />associated appurtenances and facilities, operated and maintained by SBSA as a part of <br /> <br />SBSA's sewerage facilities under and pursuant to the joint exercise of powers <br /> <br />agreement described in paragraph 1 a hereof. Said treatment plant, pumping stations, <br /> <br />appurtenances and facilities, and the construction therefore are described in those <br /> <br />certain Plans and Specifications prepared by Jenks and Harrison, Consulting Sanitary <br /> <br />and Civil Engineers, which are on file with SBSA. <br /> <br />- 2 - <br /> <br />0671.54 <br />
